WHOA! House Riot Panel Will ‘Immediately’ Pursue Charges on Bannon if He no-shows

Steve Bannon has a choice to make today: Either he appears for a deposition as ordered by House committee investigating the Capitol riot, or the panel will immediately pursue criminal contempt charges against him. CNN reports the committee is getting ready to seek a referral for criminal contempt as soon as the ex-Trump adviser’s subpoena deadline expires later today. Bannon’s lawyer made clear in a letter Wednesday that his client has absolutely no intention of giving testimony or handing documents to the committee until a ruling is made over whether former President Donald Trump can assert executive privilege to prevent witnesses from speaking to the panel. CNN’s sources said the committee would take the initial steps to send a referral to the Department of Justice within hours of Thursday’s deadline. Three other Trump administration officials face subpoena deadlines this week.

NICE!!

LOCK HIM UP!

Looks like Pelosi and Cheney wont be sending the US Marshalls to kick in Bannon’s door after all, the political theater just lost the battle to the MAGA General Stephen K Bannon.

Question for those who know the law, if he’s arrested, does this jeopardize his pardon?

No. A pardon is forever. You can't go back and re-imprison him for something he was pardoned for simply because he gets arrested for contempt of Congress while courts make rulings on executive privilege. Though it is very unlikely he'll be arrested for that while such decisions are litigated.

Running Out the Clock
It has now been over nine months since the January 6 attack on the Capitol, and none of the key perpetrators – Trump, Bannon, Flynn, Stone, etc – have been held accountable. And now they are dodging and defying subpoenas! What the Democrats are showing is that you cannot fight hate speech with weasel words, and you cannot fight accelerationism with inertia. This whole gang is running out the clock – the GOP and the transnational crime syndicate that backs them.

I hope I'm wrong, but I'm betting the Dems do nothing meaningful about it.

Thanks, there was chatter on Twitter and I thought they were binding.

  • Presidential communications: The Supreme Court’s 1974 decision in United States v. Nixon discussed the need to keep communications between the president and senior advisers private. The court said that presidents may not speak with candor when discussing important matters if they thought their statements would eventually be made public.

I would be surprised if Bannon qualified as a Senior Advisor. I guess it’s time for the courts to settle this issue.

The house is a little late acquiring balls. They should have pursued criminal charges on others previously as well.
Better late than never, I suppose.

The mills of the gods grind slowly, but they’re Mixmasters compared to watching Congress and the Department of Justice move on this matter. I have been staunchly in the camp of take the time you need. I have believed from the jump that there’s more going on underground at the DOJ than we know about. But even my patience gauge is blinking red. It’s not enough to be doing something. The country needs to see you doing something. It needs to see that to build its confidence that justice is coming. It also needs to see it as a kind of vicarious triumph over all the worst cynicism and corruption that attended the last administration*. A Steve Bannon perp walk would do nicely.

When I see it I'll believe it.
