California Supreme Court upholds gay marriage ban

SAN FRANCISCO (AP) - The California Supreme Court has upheld a voter-approved ban on same-sex marriage, but it also decided that the estimated 18,000 gay couples who tied the knot before the law took effect will stay wed.

The decision Tuesday rejected an argument by gay rights activists that the ban revised the California constitution's equal protection clause to such a dramatic degree that it first needed the Legislature's approval.

The announcement of the decision caused outcry among a sea of demonstrators who had gathered in front of the San Francisco courthouse awaiting the ruling.

California is a conservative WASTELAND. The fact that many good people live on the coasts doesn't make the mainland part a place that isn't infested with darkness and evil.

The coast is where the bulk of the population resides. Hardly anyone lives north of San Fran or east of the coastal cities. The only real exception to those rules is Sacramento, because its the capital...
 
I applaud the decision. While I am not necessarily in favor of proposition 8, the will of the people of California must be respected, not ignored according to judicial whim.

This is an atrocity. It's a mockery of the US constitution.

Where in the US Constitution is ANY form of marriage a guaranteed right?
 
This is totally an incorrect question, the ultimate red herring. The real question is where in the constitution does the government have any power over marriage?

States are granted such authority via the the 10th Amendment. Accordingly, the Federal government has no authority over marriage, and should stay out of the issue altogether.

The federal constitution guarantees gay marriage. 14th amendment, bitches.

State constitutions are general documents that usually give state legislatures power over anything specifically not prohibited, unlike the federal consttitution, which gives congress power only over things included (like the general welfare clause, commerce, etc...)

LMFAO... The "federal constitution" doesn't guarantee gay anything. The 14th Amendment was specifically designed to give blacks some level of civil rights following emancipation. Marriage is not a right, it is a mostly religious ceremonial ritual, where a man and woman are joined in holy matrimony.

It's funny you should mention the 14th, because it is precisely the reason we do not need to redefine "marriage" and base it on sexual lifestyle preference. Read the part about "equal protection under the law" and consider what you are going to say when you adopt gay marriage and some pedophile comes along and thinks we need to reduce the age of sexual consent to 12, and allow adults to marry and fuck kids. Yeah, it seems pretty outrageous today, but base our laws on "sexual lifestyle choice" and this is the can of worms you open. Every group of perverts in America, will be demanding their 14th Amendment Constitutional Rights! What are you going to tell them?

Before your emotive (or drunk) ass gets compelled to post such idiocy about constitutionality of gay marriage, think about why the California Supreme Court didn't agree with you. I know it's California, but I kind of think the justices have heard of the 14th Amendment. Why, if gay marriage is so clearly a guaranteed right, would they would have ruled as they did?
