Ted Stevens ‘Conviction’ To Be Voided

Morning Edition, April 1, 2009 · The Justice Department will drop all charges against former Sen. Ted Stevens of Alaska, NPR has learned.

A jury convicted Stevens last fall of seven counts of lying on his Senate disclosure form in order to conceal $250,000 in gifts from an oil industry executive and other friends. Stevens was the longest-serving Republican in the Senate, however, he lost his bid for an eighth full term in office just days after he was convicted. Since then, charges of prosecutorial misconduct have delayed his sentencing and prompted defense motions for a new trial.

According to Justice Department officials, U.S. Attorney General Eric Holder has decided to drop the case against Stevens rather than continue to defend the conviction in the face of persistent problems stemming from the actions of prosecutors.

The judge in the Stevens case has repeatedly delayed sentencing and criticized trial prosecutors for what he’s called prosecutorial misconduct. At one point, prosecutors were held in contempt. Things got so bad that the Justice Department finally replaced the trial team, including top-ranking officials in the office of public integrity. That’s the department’s section charged with prosecuting public corruption cases.

Stevens' lawyers praised Holder's decision and said it was "justified by the extraordinary evidence of government corruption in the prosecution of Sen. Stevens."

The lawyers, Brendan Sullivan and Robert Cary, called the case "a sad story and a warning to everyone. Any citizen can be convicted if prosecutors are hell-bent on ignoring the Constitution and willing to present false evidence."

Stevens said, "I always knew that there would be a day when the cloud that surrounded me would be removed. That day has finally come. It is unfortunate that an election was affected by proceedings now recognized as unfair. It was my great honor to serve the state of Alaska in the United States Senate for 40 years."

Not that my opinion matters but I must say I was not all that disappointed to see Stevens gone. Yes his vote would be important in this current Congress but he was old school and his spending ways did nothing to further the limited government cause. If that cause is to be furthered by the Republican Party then I'm glad Stevens is not a part of it.

agree with you and I lived there..if I'm going to be griping about the lifers in our government no matter what party they are and how corrupt some have become, I was also glad to see Stevens go even though we could used his vote..

I really would like to see some type of term limits for these people..
 
They deserve a congressional medal of honor and a lifetime pension.

why? for screwing up a case by hiding evidence? If they had the evidence to convict him, then they damned well should have convicted him. As it stands now, there's a highly unethical, probably immoral, and most likely guilty former politician who is free on the streets now and you want to give the idiot prosecutors a medal?

Stevens is guilty, but the conviction probably won't stick. There was lots of evidence of his guilt. Everyday that he ate at the "The Crossing" and one of his cronies pays for lunch he violates the law, but they all claim this doesn't happen and it does. If he lies about having his lunches paid for, then he will lie about the bigger things he did not claim. Old timers like Stevens, as long as they have been in office, they are guilty of taking something for a favor.

There is no point in continuing the farce except to put Stevens in jail....and that outcome has no value to Dimocrats....

They've ruined him, he lost the election, they destroyed his good name.....
all in all, the Democrats can say 'mission accomplished' and their will be absolutely no backlash on them....its just another victory for them....doing what they are master at,...gutter politics.....

Getting his conviction overturned means that those other swindlers we call members of congress can breathe easier about their own skimming.

The BIG Point you are all missing here is the new head of the DOJ ( Obama appointed)

Looked over this case and realized that even though the evidence is overwhelming the Idiots who prosecuted him ( Bush DOJ christian law school assholes) LIED and cheated in the case to make their crimes worse than this stupid old mans crimes.

The guy is guilty as hell but will go free because of the lying and cheating of the DOJ under Bush.
