The law says he has to request an extension, but it by no means certain that the EU would grant one anyway. Appointing a commissioner is at the behest of the government, who can use their veto to ensure that they will get their way. Corbyn and Labour are shitting bricks as they know they will be crucified at the polls for their Machiavellian deceit.
