We don’t need a constitutional amendment, the language of the 14th is clear - it does not apply to children of non-citizens because they are not subject to our jurisdiction/laws simply due to the fact that they are not here legally.

Aside from the 14th Amendment, the Constitution grants Congress the power to regulate naturalization. According to current naturalization laws a child is a citizen if born in the U. S. and subject to the jurisdiction thereof. The following explains the term jurisdiction:

"b) Child born subject to the jurisdiction of the United States. A child born in the United States is born subject to the jurisdiction of the United States and is a United States citizen if the parent is not a “foreign diplomatic officer” as defined in paragraph (a)(2) of this section. This includes, for example, a child born in the United States to one of the following foreign government officials or employees:"

There were no such thing as illegal aliens when the 14th Amendment was ratified because there were no limits on immigration until the 1880s.

Interesting question: An American woman abroad has a child through a surrogate. Is the child a citizen?
