But they are not ' over Japan ' are they. They are in international airspace. ' Japan ' doesn't hold sway over any airspace above 12 miles. The test vehicle passed 338 miles higher than that.
It was clearly no threat to Japan- as tracking verified in real-time. It is being used to curry the support of war-mongering tossers to whom legalities are only important when it suits them.

there is only so much an ICBM can do as a "counter-measure" -i don't think it can even release chaff.
Our ABM systems are getting better - I think Japan has some too ( besides basic Aegis)

The U-2 has supposedly a 70,000 feet ceiling (13 miles). The altitude at which Power's plane was shot down is still debated. Just putting it out there :)

The accepted national ceiling is 12 miles. As far as I'm aware there are no stated restrictions on types of vehicle using airspace above that ceiling.
