"Permitting" is not the same as "regulation". Look up the definition of "permit", then "regulation". They are two different words entirely.
There are many activities that do not require a permit, yet the individual or corporation is still required to abide by regulations. For example, it is against federal regulations to take a shit in a federal Forest within a certain number of feet of a watercourse. However it does not require a permit to take a shit in a federal Forest.
The simple lack of a permit does not exempt you from regulation. What a permit exemption does is remove the uncertainty for investors in a project, since FedCo has proven itself to be incompetent about the permitting process, sometimes stringing along investors for year or decades in a long, arduous, but more importantly politicized permitting process.
