Obviously, you are ignorant of these kinds of seizures. "Criminal" means conviction. They don't even need to be criminally charged in asset forfeiture cases.
Fact: It is well documented that several innocent people who've done nothing wrong have been victimized by asset seizures and lost large amounts of money and property without ever having been charged. In many cases, they've had to hire attorneys to get their money back, and often times, only got part of it. Once law enforcement gets it's hands on your money, they do not want to let it go easily.

the failure of both conservatives and liberals is in their perception of criminal. all too often, the second someone is arrested, you brand them a criminal. you absolve yourself of any responsibility for it by assuming, falsely, that if they weren't a criminal, then they would not have been arrested. reality is that the government can arrest you for anything. reality is that current federal asset forfeiture laws allow for seizure based upon suspicion and forces the 'citizen' to fight the government (an entity with unlimited resources) to have their property returned.
