Kennedy clerk says retirement coming soon

Yeah your predictions are so great. If Roe were overturned abortion would still be legal. It would just go back to the states where it belongs

I agree that Roberts has already shown tendencies to lean left. The jury is out on Gorsuch.

Just need Ginsberg to leave

The bolded is true, but the actual overturning of Roe would be pretty seismic. MOST people do not think it can be overturned; I have even heard many conservatives say that.

If it is, it will be perceived as a hard tilt right by the electorate. The electorate doesn't like hard tilts, either way.

Why can't it be overturned.

Queer marriage was a hard tilt. You will be fine. You will still be able to kill babies. Just at the state level

Oh, I definitely think it can be overturned. I've just heard many say that it can't be - people have convinced themselves that SCOTUS would never do that. They're definitely wrong on that. And I agree - I feel for women in the states that will immediately take advantage of that, but there will still be a lot of states that will keep it legal.

But the overturning of it will be perceived nationally as a huge overreach to the right - just like Obamacare was a huge overreach to the left.

Roe v wade is a bullshit justification in the first place.

im one of the conservatives tnat doubts it will be overturned though.

that said it belongs to the states

It's a practical compromise, and I think a pretty good one. It makes viability the deciding factor. Anything else in either direction would have been too big of a concession either side, and the legality of the extreme on either side is murky at best.
