I didn't think much when I read about Spicer giving interviews hiding in the bushes Tuesday night after Trump fired Comey.

But it was brought up at work today that he was breaking the law. Will charges be filed under the UCMJ?

Then I remembered when my Commander advised us during the 2012 election campaign to not participate in partisan politics while on duty. Federal Law (Titles 10, 2, and 18, United States Code), DOD directives, and other military regulations strictly specify a military active duty person's participation in partisan political activities.

DOD defines "partisan political activity" as "activity supporting or relating to candidates representing, or issues specifically identified with, national or State political parties and associated or ancillary organizations."

You are right. He is on active duty.
 
Considering he reports to the Commander in Chief I think he will be ok. But you guys should press this.

As strong advocates for civilian control of the military, we submitted a blistering piece to War on the Rocks outlining the proper limitations for general officers publicly speaking on matters of policy, explaining the rationale for those limitations, and ending with Amos standing at attention in the Oval Office being reminded of his place in the chain of command. It was right on all counts — except for the not so minor detail that Amos hadn’t done what we were criticizing him for doing.

The point isn't if he criticized or defended Obama policy, the point is he made a partisan speech in uniform ...

I understand that, but if you'd read the link I provided, you'd see a viable argument against that claim.

Was he charged under the UCMJ? No. But Amos, did relinquish command shortly after that speech and retire that year.
