She wasn't indicted because of "intent" but Comey listed her violations -he just chose not to indict.

There had to be an investigation to fact find -her Emails had to be read up against testimony from others
and her own serial lying over the period from March 2015 (her first attempt at explaining her private server- the UN press event)
and looked at against her actions documented.

she definately violated the statute ( gross carelessness) which doesn't require intent.
But Comey had to make the call since Lynch impeached herself by the meeting with Bill
