DNC Argues In Court: We Never Promised Anyone We Would Be Fair

The completely rigged nature of political primaries was blown wide open with the release of a transcript from a lawsuit by Bernie Sanders supporters against the Democratic National Committee.

Sanders supporters essentially accused the DNC and then-chairwoman Debbie Wasserman Schultz of playing favorites and picking Hillary Clinton to win over their candidate.

The response from DNC lawyers was compelling: they didn’t deny they were playing favorites. Rather, they argued, it was well within their rights to do so. They don’t need to be fair at all.

Early in the hearing – and going over the DNC’s own charter – lawyers claimed the section that requires the committee ensure neutrality in the primaries is merely “a discretionary rule that it didn’t need to adopt to begin with.”

They make their own rules – and break them. Essentially, they argued they can make any decision they want on a candidate – or interpret their own rules anyway they wanted – and there was nothing anybody could do about it.

Before this, DNC lawyers actually tried to argue that Sanders supporters knew going in that the system was rigged, so they had nothing to complain about. This time, they made the same argument: “The Court would have to find that people who fervently supported Bernie Sanders and who purportedly didn’t know that this favoritism was going on would have not given to Mr. Sanders, to Senator Sanders, if they had known that there was this purported favoritism.”

The DNC Charter MEANS Something. The lawyer representing Sanders supporters said that the DNC Charter – which governs how the Democrats will pick a presidential candidate – is an inherent and important part of democracy in America, not just some political rhetoric.

“People paid money in reliance on the understanding that the primary elections for the Democratic nominee—nominating process in 2016 were fair and impartial,” Jared Beck said. “And that’s not just a bedrock assumption that we would assume just by virtue of the fact that we live in a democracy, and we assume that our elections are run in a fair and impartial manner. But that’s what the Democratic National Committee’s own charter says. It says it in black and white. And they can’t deny that.”

He added, “Not only is it in the charter, but it was stated over and over again in the media by the Democratic National Committee’s employees, including Congresswoman Wassermann Schultz, that they were, in fact, acting in compliance with the charter. And they said it again and again, and we’ve cited several instances of that in the case.”

DNC Doubles Down. Defending their bias, the DNC’s lawyers even argued at one point that the words “impartial” and “evenhanded” – words used in the DNC charter – were words that a court couldn’t properly interpret.

I see nowhere here where the DNC is required to "ensure neutrality in the primaries". And I voted for Bernie.

Duties and Powers. The Democratic National Committee shall have general responsibility
for the affairs of the Democratic Party between National Conventions, subject to the provisions of the
Charter and to the resolutions or other official actions of the National Convention. This responsibility shall
include, but not be limited to:
(a) Issuing the Call to the National Convention;
(b) Conducting the Party’s Presidential Campaign;
(c) Filling vacancies in the nominations for the office of the President and Vice President;
(d) Assisting state and local Democratic Party organizations in the election of their candidates
and the education of their voters;
(e) Formulating and disseminating statements of Party policy, promoting programs for the
systematic study of public policy issues, through participation of members of the Democratic National
Committee and through specific projects administered under the authority of the Chairperson of the
Democratic National Committee;
(f) Providing for the election or appointment of a Chairperson, five Vice Chairpersons, three
of whom shall be of the opposite sex of the Chairperson, one of whom shall be the President of the
Association of State Democratic Chairs and one of whom shall be Vice Chairperson for Voter Registration
and Participation, a Treasurer, a National Finance Chair, a Secretary and other appropriate officers of the
National Committee as shall be determined by the Committee, and for the filling of vacancies;
(g) Establishing and maintaining National Headquarters of the Party;
(h) Promoting and encouraging Party activities at every level, including but not limited to the
following:
(i) promoting and encouraging implementation of all Party mandates;
(ii) the fulfillment by the Party of its platform pledge and other commitments;
(iii) establishment and support of an adequate system of political research;
(iv) the preparation, distribution and communication of Party information to its
members and the general public;
(v) the development and maintenance of a program of public relations for the Party;
and
(vi) development of a program for the coordination of Party committees,
organizations, groups, public officials and members.
(I) Devising and executing ways and means of financing activities of the Party;
 
Why do you care?

Because I don't like to see anyone cheated out of what their trying to do.
Everyone should be free to promote and run who they want as a candidate and their political party leaders have no business lying to them.

The bigger question here, is WHY don't you care?

Democratic process is supposed to be fair. It's one of the selling points. You would think a fair process would be implicit given they named themselves the Democrat party and they tout themselves as the protectors of democracy.

I agree. But the issue here is it's in violation of the Charter.

Rune already stated how pissed-off he was about this. I think you mean that Dems who supported Crooked Hillary over Bernmaster Sandy will not discuss.

I did not see that as it was not in this thread. Thank you for the clarification that one JPP liberal discussed the OP.
