It is not clear why Mr. Comey did not issue a statement himself. He is the most senior law enforcement official who was kept on the job as the Obama administration gave way to the Trump administration. And while the Justice Department applies for intelligence-gathering warrants, the F.B.I. keeps its own records and is in a position to know whether Mr. Trump’s claims are true. While intelligence officials do not normally discuss the existence or nonexistence of surveillance warrants, no law prevents Mr. Comey from issuing the statement.
So why would Comey ask the DOJ to something he is capable of doing as head of the FBI ? He should know.

If you have the goods on Trump, why leave FISA out of the loop? The court was formed back in the 80's or 70's for the purposes of warranting searches involving foreign governments. In fact, that would be the first thing to do, if some form of espionage is suspected between Trump and the Russians.
No matter how you slice it, it doesn't come out well for democrats and Trump haters.
If DOJ was turned down by FISA for lack of evidence---well, there goes your conspiracy theory.
If FISA issued the warrant, then Trump WAS tapped. Which raises the question of their findings. If they have something, why are they sitting on it?
My guess is they have nothing to show or they would have let it out in October.

The FBI is a division of the Justice Department. He wanted to give higher ups the chance to do the right thing, they did not. Now the ball is in his court, what will he do? I know in the last few weeks of hte campaign what he chose regarding HRC>

Maybe they found the evidence more recently than October...
Maybe they found the evidence in a different way than by using FISA wiretaps.
Maybe they did legitimately Tap the Campaign's phones.
Maybe they are not commenting because they don't comment on open investigations.
Maybe they have some evidence, but not enough to convict and are giving them rope.
