FBI reopens investigation into Hillary Clinton's e-mails

I know perfectly well what Comey said... that what she did was careless but there was no evidence it was illegal. That's what this is about, illegality, not stupidity.
ah, but the conclusions Comey drew were based on the emails that had been available at that time......the tens of thousands of emails that Huma didn't have an opportunity to bleach may well provide evidence of intent that Comey had been looking for.......

Yes...his opinion that no reasonable prosecutor would bring charges. Many felt he overstepped.

Sex sells. If not for the sexual predator status, we'd be hearing A LOT more about Trump paying $25k to keep Fla. AG from bringing a case against Trump for his bogus Trump U.

If Comey is corrupt in your opinion, then why do you give any credence to his latest political move?

It's likely an attempt to redeem himself; or like I speculated earlier, career people within the agency may have forced his hand. In neither case is it a political move, per se, since his motivations aren't partisan.

Sex does sell and it also makes for a great diversion from substantive issues. And it was working pretty well till Friday when Comey upset the apple cart.

According to the legal analyses I've heard / seen / read on it:
according to the law, there has to be destructive criminal intent. I invite anyone to post the EXACT WORDING OF THE STATUTE.

actually no......"destructive criminal intent" is not required by any of the provisions........intent is only required by subsections a) and b).....subsections c), d), e), f), and g) do not require intent, merely knowledge.....

in addition it would be a violation of Executive Order 13526
https://www.whitehouse.gov/the-press-office/executive-order-classified-national-security-information
the consequences of such a violation would be the immediate and permanent cancellation of her security clearance......

Rumors aside...Isn't Comey's only apparent issue the fact that he made the comment re. his opinion of what any prosecutor would do? He delivered the evidence, and DOJ made their decision.

If Comey made this public due to some internal strife, that really makes the entire FBI look very bad.

1. The DOJ....made no decision, Mr. FBI unilaterally made the decision not to INDITE, there was no prosecutor appointed, because Mr. FBI found no grounds for it. 2. And of course its the FBI (the people's investigative police dept.) that looks bad (according to the media apologists) and not the criminal under FBI investigation in 2 separate cases.

3. Its the only time in US History where a candidate has been the subject of not 1 but 2 criminal investigations in which the 5th has been invoked, witnesses granted immunity, yet...no indictment has come forth, no Independent special prosecutor has been appointed (might less a congressional oversight committee)...while the same party's power base in the current administration whose political appointee's (Hildabeast) BOSS...is the sole source of investigating the greatest crime that could be suspected.....suspected Corruption and Treason. Of course its Obamy's personal appointee in the DOJ that is calling the shots....but declares she has plausible deniability because there has not even been an indictment to come forth. Kinda makes one wonder what Bill and the DOJ boss lady talked about when Bill flagged down her personal jet to have a cup of coffee and a doughnut....don't it?

3. The powers that be WANT NO INDEPENDENT PROSECUTOR...nor any independent committee investigative body.

Now the FBI is being charged by the Media and the Clinton apologists as being the source of breaking from TRADITION and LOOKS BAD? Really? Once again the Clinton machine is attempting to make the world look guilty because they are suspected of having their hands in the cookie jar...while playing the VICTIM CARD. Priceless.

Just how stupid and power mad are these APOLOGISTS?

Can somebody tell me how you can trust a President who is so casual about the handling of confidential and secret documents? If it were anybody else then their security clearance would has been taken away at the very least.

The phrase "Whoever, for the purpose of obtaining information respecting the national defense with intent or reason to believe that the information is to be used to the injury of the United States or to the advantage of any foreign nation..."

Comey could not prove intent. "We did not find evidence sufficient to establish that she knew she was sending classified information beyond a reasonable doubt to meet the intent standard," Comey explained.

ALL of the conditions weren't met. For example, some of the emails were marked "classified" after the fact.

Section 1.1. Classification Standards. (a) Information may be originally classified under the terms of this order only if all of the following conditions are met:

The phrase "Whoever, for the purpose of obtaining information respecting the national defense with intent or reason to believe that the information is to be used to the injury of the United States or to the advantage of any foreign nation..."

that is a), which I agreed required intent.....so does b).......however the rest do not.......the text is right in front of you, Chrispy........you can't pretend three fourths of the law simply doesn't exist......

we all know that excuse doesn't fly, Chrispy.....give it up......

If you aren't going to acknowledge how nitpicking the law can get, I can't help you.

Interesting analysis today. Comey did not pass the investigation over to the DOJ is because he knew Lynch would dismiss with prejudice and there'd be no way to reopen. Now he has a better chance to get justice.

And if you don't know that while factually valid your stated point is immaterial here, then I can help you, but won't.

At issue here isn't "nitpicking". These are communications with the Secretary of State of the United States of America.

One of two things is true.

a) Either Hillary was such a slacker that she didn't communicate anything of importance via that e-mail conduit during her tenure in that office, or

b) she did, and compromised U.S. national secrecy in the process by what she has already admitted was a mistake.

Either way; "nitpicking", not an issue.

This is about why Comey failed to prosecute her the first time around, not what you're stating. He said he couldn't prove intent. Maybe another legal beagle could, but we're stuck with Comey's decision for the time being.

FBI Director James Comey’s decision to revisit the Hillary Clinton email-private server case was purportedly trigged by New York agents working on the unrelated case of former New York Democratic Rep. Anthony Weiner allegedly “sexting” an underage female.

A law enforcement source told Fox News on Sunday that the New York team told agents involved in the investigation into Clinton using a private server system while secretary of state:
“We think we've come across some documents pertinent to your investigation."

Weiner is married to top Clinton aide Huma Abedin, and a laptop connected to the sexting case was purportedly shared by the couple.

Comey was further compelled to review the documents based on two factors: the volume of documents and his commitment under oath to Congress to review “any new and substantial information,” the source also said.

There ya go. They were all in on it and now looking back, I think this might have been Comey's way of saying to himself, "Oh yeah?? Not this time." I think he is crazy like a fox. He has outsmarted them. It was so blatantly obvious how he really wanted the public to know up front about all the dirt on her. Then, he does a 180 and says, "We will not indict."

I fully believe as well that DOJ would have dismissed with prejudice.

I owe Comey an apology. It's going to be scary good to see how all this now pans out.

Trick or treat Hillary...have a happy Halloween aboard Broomstick One trying to finagle your way out of this one.
