A Michigan man who can’t buy a gun has won a key decision from a federal appeals court.

Clifford Tyler, 74, said his constitutional right to bear arms is violated by a federal law that prohibits gun ownership if someone has been admitted to a mental hospital.

Tyler’s wife ran away with another man, depleted his finances and filed for divorce. He was deeply upset, and his daughters feared he was a danger.

Tyler was ordered to a hospital.

“There is no indication of the continued risk presented by people who were involuntarily committed,” Judge Julia Smith Gibbons wrote in the lead opinion.

Judge Karen Nelson Moore said the law is constitutional.

Where do judges get authority to tell us what the constitution means?. The tenth amendment says the power is with the states or the people. Questions of constitutionality should be settled by juries.

Same thing can be said of people who committed a minor felony years ago and have been model citizens since. So why is their second amendment right denied forever? THINK
 
Where does it say that this guy was judged "insane?"

This decision comes in the wake of the US Court of Appeals for the Third Circuit ruling last week that restored gun ownership rights of individuals convicted of crimes.
