The constitution says "all legislative powers herein granted shall be vested in a congress of the united states". So neither obama nor ATF bureaucrats are allowed to write laws - though they do it all the time.

aug 30 2016 As reported on Ammoland, a sudden ATF rule change promulgated entirely without warning in a newsletter has reclassified a critical component of smokeless powder as a “high explosive.”

The problem is that there are very strict rules governing the storage and transport of high explosives, and the ammunition supply chain is totally unprepared to suddenly comply with those rules.

Overhauling the ammunition supply chain to accommodate those rules will be a long and expensive process, which would be bad enough news for ammo prices. But the knockout blow is the fact that the industry was given no warning and zero grace period, so they’re just screwed, because as of yesterday they’re now in sudden violation of federal law.

Given that this ruling will result in a drastic shortage of smokeless powder, it’s going to bite reloaders just as hard as everyone else.

This stunt is also going to hurt the DoD as well as civilians. Given the collateral damage to military ammo supplies, I don’t expect this ruling to stand. Something will have to be done or else the troops will run out of ammo.

the only problem with your position is that congress surrendered their power to be the only legislative body when they started doing things like the war powers act and creating all the alphabet agencies.
 
This is defacto gun control for Obama. An old liberal trick. We can't control or ban guns, so we will control ammo.

The war powers act was a bad idea but the fact remains that congress by itself cannot surrender a power the constitution gives them. If they wish to do so they must go thru the amending process which means 3/4 of the states must agree to the power transfer. You are both ignorant and stupid. THINK
 
If you libs want to ban guns you need to get congress to pass a law like the constitution says. Nameless bureaucrats who answer to no one do not have the authority.

while I agree with the constitutional premise you're promoting, the statist courts didn't, therefore the all 3 branches have the power to make laws now.
