Another sex offender has avoided prison after a Colorado judge decided time behind bars "wouldn't be good" for the convicted rapist.

Austin James Wilkerson told the friends of an intoxicated woman that he would escort her home safely. He incapacitated woman instead, and was convicted. Wilkerson admitted to assaulting the woman.

The victim pleaded with Boulder District Judge Patrick Butler to consider a prison sentence for her rapist.

"Have as much mercy for the rapist as he did for me that night," the victim told Butler during tearful testimony.

Butler spared Wilkerson prison time. "I've struggled, to be quite frank, with the idea of, 'Do I put him in prison?'" Butler wondered aloud during sentencing.

An analysis of Justice Department data found that 97 out of 100 convicted rapists aren't put in prison.

A another great injustice. How sad for our society.
 
This speaks to a larger issue in that our prison system is corrupt and should't be a place where people get tortured, raped, and killed in turn. All prisoners should be safe. A society is only as good as how we treat our worst. The solution isn't to let a rapist go though, but to make prisons safer so that they can serve their humane punishments.
