I thought you were a lawyer? how does "extreme carelessness" not equate to "gross negligence" -they are one and the same.

She "downloaded" ( received) classified Emails ( classified at the time) on a private server = Comeys "extreme carelessness"
as well as using her blackberry in unsecured areas despite being warned - and much more.
All of that goes to the subsection. Intent is not needed.

The case(s) shown in reference is the same = exposing classified info in a non-secure manner with gross negligence, with no malicious intent.

1.saying they are different when the verbiage shows they are equivalent is not a persuasive argument.
2.Again you would need to find some reasoning why (f)(1) does not apply-her pattern of behavior shows gross negligence
( for instance her rejecting a desktop in Mahogany Row to check her Emails in favor of her Blackberry -1 of many examples)

I had forgotten that one. She gave her lawyer a thumb drive that he supposedly (and most likey) put into his office safe.
But that safe was not a secured area under definition to hold classified data
 
There was no investigation into if documents were stored on a blackberry. I don't know if they were or not, that might make a difference but they did not look there.
it was the fact her blackberry was tied to her unsecured Email server(s) - according to Comey using in a "remote hostile area (sic?) allowed foreign intelligence services hacking -not just foreign attacks from overseas hackers while stateside.
Plus all US State dept employeese were warned not to do so.
