It really depends on your attitude when stating it. If you are coming from an attitude that you are superior and it is a prideful observation then it is judgemental, if you come from a position that his words and actions don't mirror Jesus teachings and to put yourself on guard against those teachings and leave his actions to God, then it isn't being judgemental but discerning.

It really depends on your attitude when stating it. Perhaps instead of saying he is a phony Christian, maybe it is about saying that his actions are not Christlike. Many holy people in the bible sinned, but they are not considered phony Jews or Christians. Christians are not perfect and sin. Sometimes it is a bad action or bad words or bad thinking, doesn't mean they are phony.
