But mistaking a gun for a Taser is a real issue among law enforcement officers. The company’s electroshock weapons were made to handle like firearms.

Greg Meyer, a retired captain with the Los Angeles Police Department, testified for the defense in the case against Mehserle and, in 2012, compiled a list of nine instances since 2001 of confusion over weapons for the Americans for Effective Law Enforcement Law Journal. Meyer said in an interview today that he hasn't found further cases of weapons confusion since 2012.

Deputy Reservists 'Pay to Play' Cop — and Not Just in Oklahoma

What do rapper Kid Rock, basketball legend Shaquille O'Neal, and Hollywood one-man-army Steven Seagal have in common, apart from their striking goatees? They're among a growing number of wealthy celebrities, entrepreneurs, and executives signing up for the chance to tote real badges and guns as deputy reservists at local police departments around the country.

Would you trust any one of them to defend your rights or to follow proper protocol in a life or death situation? These are questions that are once again being asked in recent weeks after a white millionaire insurance executive attached to the reserve contingent of Tulsa County Sheriff's Office fatally shot an unarmed black suspect in Oklahoma, claiming to mistake his firearm for a Taser.

Robert Bates, 73, who has been charged with the second-degree manslaughter of Eric Harris, 44, during an undercover operation on April 2, was a reservist deputy serving on the sheriff's Violent Crime Task Force. He had reportedly paid handsomely for the privilege, donating cars and thousands of dollars in other equipment to the department since joining in 2007.

In a video of the fatal shooting, Bates, who says he mistakenly fired his service weapon instead of his stun gun, can be heard crying, "I shot him! I'm sorry!" The insurance company owner has since been released on $25,000 bail and told CNN on Friday that he regrets the incident, but said, "It can happen to anyone."

In the interview, Bates, a longtime friend and former campaign donor to Tulsa's sheriff, Stanley Glanz, also denied allegations that he did not complete the required 480 hours of training and firearms certification that qualified him to serve as an advanced reservist — the highest rank among Tulsa's auxiliary forces — that essentially allowed him to carry out the same duties as any regular deputy.

The sheriff's department on Friday deflected the same allegations unnamed sources made to the Tulsa World newspaper, saying it had yet to locate Bates's training records, but that the sheriff has the right to waive any department requirements and policies, and there was a possibility that this occurred in this instance.

"The media outlet that is putting this information out is using unconfirmed and unidentified sources and also relying on anonymity," said Major Shannon Clark, spokesman for the Tulsa County Sheriff's Office. "We don't respond to rumor."

The case appears to highlight the disquieting precept that money really can buy anything, including the right to allegedly sidestep mandatory law enforcement training at the potential risk of human life. It could not have come at a worse time, as departments around the country weather fierce criticism over systemic and pervasive policing culture that incubates perceptions among its police officers that racial bias and excessive use of force is acceptable and even sanctioned.

Former Sheriff Stanley Glanz was charged by prosecutors Tuesday afternoon with two criminal misdemeanors before a brief court appearance where he was arraigned.

Grand jurors alleged in the first count that Glanz drove SUVs that were county-owned and fueled for travel when he also took a $600 monthly stipend to use his own vehicle. Secondly, the grand jury accused the ex-sheriff of denying lawful requests for the release of a 2009 internal investigation into friend and former Reserve Deputy Robert Bates that was at the heart of the burgeoning scandal at the Sheriff’s Office.

so there will be ZERO accountability for Glanz' complicity in the murder that Bates committed.

How many times has that happened in 11 years, with a reserve deputy? I bet it is less than 11 and yet you are making a big deal out of it. Even experts say it is an issue, but of course you know better just like you know what race Marco but can't be bothered to say which race.

Where have I tried to justify what the deputy did. And, by the way, under OK law he is in fact considered deputy, so not sure why you put that in quotes.

One of the possible scenarios expressed by those who have observed the video of the New Year’s Day shooting on Bay Area Rapid Transit (BART) in Oakland, Calif. is that the officer intended to use his TASER and mistakenly grabbed his firearm. This is altogether possible, and we have written about similar tragedies in the past.

How this could happen is truly at the root of what we understand about human mistakes. For example, we have learned that the disruption of a motor program to a high level can cause us to make mistakes. James Reason in his book, Human Error, explains how this occurs and calls these errors "double-capture slips." In the BART video, we see the officer who is straddling the subject who is ultimately killed reach for his TASER, then drop his hand to the subject in what appears to be a controlling movement. So the officer appeared to initiate the motor program to draw the TASER and was then interrupted. He then rises and draws his firearm and moments later fires into the back of the struggling subject.

Ex-Okla. Volunteer Deputy Sentenced To 4 Years For Fatally Shooting Man


TULSA, Okla. (AP) — A former Oklahoma volunteer sheriff's deputy who said he mistook his handgun for his stun gun when he fatally shot an unarmed suspect last year was sentenced Tuesday to four years in prison.

A judge gave Robert Bates, 74, the maximum penalty recommended by jurors who last month convicted the wealthy insurance executive of second-degree manslaughter.

Bates fatally shot Eric Harris on April 2, 2015, while working with Tulsa County sheriff's deputies during an illegal gun sales sting. Harris, who had run from deputies, was restrained and unarmed when he was shot. Harris was black and Bates is white, but Harris' family has said they don't believe race played a role.

The shooting, which was captured on video, sparked several investigations. Among other things, the investigations revealed an internal memo questioning Bates' qualifications as a volunteer deputy and showed that Bates, a close friend of the sheriff's, had donated thousands of dollars in cash, vehicles and equipment to the sheriff's office.

Judge Bill Musseman said handing down the prison sentence was a "legitimate and moral consequence" of Bates' actions. He said he took into account Bates' age, failing health and dozens of letters written by community members asking for leniency.
