A policy barring a transgender student from using the boys' restrooms at his Virginia high school is discriminatory, a federal appeals court ruled Tuesday.

In a case closely watched by public schools and transgender-rights activists across the country, a three-judge panel of the 4th U.S. Circuit Court of Appeals overturned the Gloucester County School Board's policy.

The appeals court's ruling establishes legal precedent in every state in the 4th Circuit, including North Carolina.

I use unisex bathrooms now when I can because they tend to be present and they tend to be cleaner.

In defiance of a recent wave of anti-transgender proposals in state legislatures across the nation, Target announced Tuesday that its transgender employees and customers are “welcome” to use the bathroom or fitting room facility that best aligns with their gender identity.

Following the U.S. Supreme Court’s 2015 ruling that legalized same-sex marriage, religious conservatives have introduced more than 100 proposed laws across the nation that authorize legal discrimination against LGBT people.

Even as a high-profile fight continues over a North Carolina law directing transgender people to use bathrooms matching the gender on their birth certificates, a federal appeals court has weighed in on a similar policy in Virginia.

Opponents of North Carolina’s measure praised the ruling and described it as a victory, while supporters of the law assailed the court for setting what they called a dangerous precedent.

This highly watched ruling now raises the question of what it means for North Carolina’s HB2, which covers public school bathrooms. North Carolina is in the 4th Circuit.

Gov. Pat McCrory (R), who signed the North Carolina law and has decried what he called “a vicious nationwide smear campaign” against the measure, said the state would have to examine the ruling’s impact on North Carolina.

McCrory said in a statement, “I think that’s bad precedent and I don’t think it’s the traditional way we do things.”

The ruling “makes plain that North Carolina’s House Bill 2 violates Title IX by discriminating against transgender students and forcing them to use the wrong restroom at school,” the American Civil Liberties Union said.

My question is how you would know if a transgender person was using the "wrong" bathroom?

I don't think I have ever seen another persons genitalia while using a public bathroom, its simply very easy to avoid.

Am I abnormal in this? Who regularly sees others genitalia while using public bathrooms?

If you are offended by trans people using the bathroom, my first response would be that you should mind your own business while in the public bathroom.
 
But Jared, do you not see how this opens the door for pedophiles and other perverts? While I don't care one way or the other, for me, I do for the dad who has to send his 9 year old daughter to the public ladies' room with someone who may or may not identify as transgender or who may simply be a pedophile. I don't think this is about "normal people" like you and me at all. And while the basis for the opposition might be transgender phobia, the concern about the above scenario and others that are similar is very real.

While I understand you concern, I don't see how this makes the bathroom more dangerous. For one thing, my 10 year old would not be allowed to go to a bathroom that was not full of people, and if it were full of people he knows how to yell.

The public bathroom is just as likely to have pedophiles in it if transgendered people are allowed in as if not. How would allowing trans people in cause a pedophile to be more likely to be in the bathroom?

Is a gay pedophile not just as likely to be in the bathroom?

Conservatives think that transgenders are pedophiles?

Pedophilia didn't seem to bother them too much when the Speaker of the House practiced it in the boy's locker room, did it?

I can see why toe-tapping Republicans who take a wide stance think that public restrooms are a place to have sex.

Maybe there should be separate facilities for Republicans.
 
Personally I don't see why bathrooms are not made unisex.

I used to go to a bar with unisex bathrooms in Tampa, there was never a problem.

At parties in my Fraternity in College the bathrooms always became unisex, never had a problem, and these were drunk college kids.
Watch your kids. Don't let them go into bathrooms alone unles they can scream or yell... don't let them go in when there is likely only one other person.... Check on them, go with them.

I would prefer some women be in the bathroom if I send my son in without me, they are more likely to be mothering and keep an eye out for male preditors.

It bothers me that people link transgenders with pedophilia. I'd like to see some statistics showing the correlation, from a legitimate source.
