A Missouri white supremacist who killed three people at two Kansas Jewish sites last year is about to find out if he will be sentenced to death. Frazier Glenn Cross Jr., also known as Glenn Miller, was convicted in August of first-degree murder in the deaths.

He was also convicted on three counts of attempted first-degree murder as well as aggravated assault for pointing a shotgun at another woman.

The same jury that convicted him recommended the death penalty.

Cross claimed because he wasn’t granted a change of venue the trial was unfair with previous media coverage. Judge Ryan said Cross presented no evidence – copies of articles, websites, etc. – to show he couldn’t obtain a fair trial in Johnson County. Because of the absence of evidence, Judge Ryan denied the motion.

Cross also motioned for a new trial on the basis that he could not speak to standby counsel when he “wanted.” Judge Ryan told Cross he was granted the right to represent himself. He said Cross couldn’t have it “both ways,” and having standby council did not give him the right to ask them procedural questions in front of the jury. Judge Ryan said Cross was representing himself, and the motion for a new trial based on not being able to ask standby council questions was denied.

Cross also filed a motion for a new trial saying Judge Ryan made gestures to “let the jury know he was on the side of conviction.”
