A sheriff's deputy in Knox County, Tennessee has been fired after he was caught on camera allegedly choking a university student Saturday night.

John Messner, a freelance photographer in Knoxville, captured Phillips with both hands around the neck of University of Tennessee student Jarod Dotson in Fort Sanders after a party. The 21-year-old can be seen falling to his knees after the man's grip apparently renders him unconscious.

Phillips has been with the Sheriff's Office since 1992. Dotson, of Powell, is an architecture major at the college.

Authorities say Dotson was publicly intoxicated and drinking from a cup 'that had an odor of an alcoholic beverage' at 23rd Street and Laurel Avenue, when he was arrested.

He was charged with public intoxication and resisting arrest. He was released Sunday morning on a $500 bond, the sheriff's office said.

The report said Dotson ignored 'repeated instructions' to go inside and apparently 'began to physically resist officers' instructions to place his hands behind his back, and at one point grabbed on to an officer's leg.'

Messner captured the frightening moment in a sequence of photographs that show the young man complying with Knox County deputies as they lead him to a police van at the University of Tennessee, before an officer uses two hands to choke the student until he is unconscious.

He went willingly and did not resist arrest, said Messner.

When they got to the police van, the arresting deputy's handcuffs were removed from the young man's wrists and replaced with cuffs from the vehicle.

During the brief moment his wrists were uncuffed, Dotson let his arms fall by his sides.

As two officers twist his arms behind his back, another deputy walks in front of the young man and wraps his hands around his neck.

The disturbing sequence of shots show the 21-year-old appear to lose consciousness, his knees buckling as he sinks to the ground, while the deputy continues to choke him or activate a pressure point that renders him unconscious.

The officers behind Dotson fiddle with his handcuffs even as he's being choked.

When the young man was unconscious, the police picked him up and the officer who choked him slapped him around the head a few times before walking off, reports Messner.

All three officers are Knox County deputies assisting the Knoxville Police Department.

The crash shattered the rear windshield of Evan Rees' Honda sedan. Sitting in the back seat, Rees, a 44-year-old teacher from Sebring, gaped through the empty window frame at the truck that had rear-ended his family on Interstate 4 east of Tampa.

He didn't have long to stare, as a man jumped from the truck's driver-side door and stormed toward the Honda. Rees, who had spent the afternoon at the Florida State Fair with his wife, sister and niece, stepped out to meet him. As a shouting match erupted, the man grabbed him, and the pair tumbled to the ground.

Bystanders pulled them apart. But as Rees rose to his knees, he found himself staring down the barrel of a Glock pistol. His assailant had drawn a gun and aimed it at him. According to the accounts of multiple witnesses, he threatened to kill Rees before lowering his gun.

"I thought I was going to die," Rees later told an investigator.

What the man pulled out next was equally shocking: a badge. The 55-year-old who had attacked and pulled a gun on Rees on the side of I-4 was Thomas Pettis, an off-duty Hillsborough County Sheriff's Office homicide detective.

The surprises weren't over. As Rees waited for the police to arrive, Pettis moved through the crowd that had gathered and punched Rees in the head.

In the wake of his actions that Feb. 15, Pettis was criminally charged and retired from the Sheriff's Office. But two months later, questions linger about law enforcement's handling of the episode.

Pettis' brandishing of a handgun could meet the statutory definition of aggravated assault with a firearm, a felony punishable by a prison sentence of at least three years and up to five. Yet he is only being prosecuted for misdemeanor battery, a charge that qualifies him for pretrial intervention programs and the avoidance of criminal penalties.

Prosecutors, following what some say is a tenuous line of legal reasoning, asserted that Pettis pointed the gun at Rees in self-defense, even though the detective initiated the conflict and the fight was already broken up when he drew his weapon.

The conduct of the Sheriff's Office also raises questions.

Despite being the only suspect in a felony criminal investigation, Pettis was never booked into the county jail, sparing him the humiliating ritual in which ordinary citizens see their mug shots land on the Internet.

And a video of the confrontation captured by a teenager on her cellphone was collected by a sheriff's deputy, who then urged the girl's parents to delete their copy of the footage before leaving the crime scene, according to the girl's father, a bystander with no connection to Pettis or Rees.


Rees and some legal professionals familiar with the case wonder whether Pettis received favorable treatment because of his status as a veteran sheriff's deputy — and, perhaps more significantly, his importance to dozens of open homicide cases.

The Berthoud police officer who was fired last October pled guilty to one count of child abuse Friday.

Jeremy Yachik was fired after he allegedly admitted to abusing a 15-year-old girl. The case led to the resignation of the police chief.

According to an arrest affidavit, Yachik abused the victim almost daily for years including tying her up with handcuffs or plastic zip ties and slamming her head into a wall.

The victim also told police that Yachik beat her with ropes, restricted her food and locked her in a dark room for hours.

FOX31 Denver talked to the victim several months ago and was given a video tape allegedly of Yachik abusing her.

A woman who says the officer is her ex-boyfriend sent the video to law enforcement officials and claims they did nothing. As a result, the police chief in Berthoud was also on leave.

In addition to the alleged criminal acts seen in the video, the affidavit for Yachik’s arrest describes alleged past crimes.

It states, “[the victim] reports having her hands bound to her back with plastic zip ties and being secluded in the laundry room of the home.” It also refers to the victim being “forced to eat ghost pepper sauce,” and “slammed [the victim’s head into the wall].”

The affidavit says police interviewed Jeremy Yachik and they wrote, “Jeremy admits he’s the one depicted in the video and admitted to the acts disclosed by the victim.”

It also details more trouble for the Berthoud police department. The question is whether the chief ignored the video when he received it in April.

The affidavit states, “In Chief Johnson’s office, evidence was collected that corroborated [the victim's] account of attempting to report this incident to [the Chief].”

Court documents in a separate case detailed more information about the accuser and the officer who is suspended. The paperwork is about a domestic violence incident that happened in March.

Long Beach police first claimed they shot and killed a man because he had “assaulted” an officer, which was promptly reported by the local media in Southern California.

Then as witnesses started coming forward, insisting they had shot him in the back, police claimed they shot and killed him because he had stepped out of the car with a “large wooden stick,” causing armed officers from multiple agencies to fear for their lives.

And then they claimed they shot him as he was walking away, but reaching into his waistband, causing them once again, to fear for their lives.

But when a witness who recorded the shooting posted the video on Youtube -- showing that the man was simply walking away with both hands in clear view when they shot him multiple times in the back -- they then claimed they had “an obstructed view”, so they really weren’t sure what was going on when they opened fire.

But obviously not so obstructed where they couldn’t strike their target from several yards away with a hail of gunfire.

it's as easy to prove as is your idiocy. if a cop commits assault on a handcuffed individual, no other cop is going to arrest him for it, therefore they are complicit in the act and just as evil.
