New Flash. Arizona Surpasses Mississippi as dumbest State in the Nation

If Arizona wants to shoot itself in the foot with the entire LGBT community as well as the vast majority of folks under 30, let 'em.

I wonder, if a straight couple walked into an Arizona restaurant, but the wife was dressed all "butchy" and the husband was acting all swishy and effeminate, could they refuse THEM service as well? I mean do you have to actually BE gay and lesbian for business owners to be able to toss you out or is acting less than feminine for a woman and less than macho for a man good enough to get you banned?

The obvious question/problem is how would "they" determine if someone was gay or not? Openly flaunting "your" gayness in a restaurant is wrong, as would be "your" openly flaunting "your" heterosexuality, but sitting down nicely to eat jusat like everyone else should not be a threat to anyone, so I am against the bill and The AZ Governor should veto it. Common sense should prevail here, there are signs that say; "We Reserve The Right To Refuse Service To Anyone", and if "you" are gay, then don't eat there just to prove a point. Why would you even want to eat in a Restaurant that is prejudiced, while there are so many that aren't?

Mott I have a right to refuse service to anyone I choose for any reason, or no reason.
No you don't. The Federal Civil Rights Act guarantees all people the right to "full and equal enjoyment of the goods, services, facilities, privileges, advantages, and accommodations of any place of public accommodation, without discrimination or segregation on the ground of race, color, religion, or national origin."

The right of public accommodation is also guaranteed to disabled citizens under the Americans with Disabilities Act, which precludes discrimination by businesses on the basis of disability.

And that law is contrary to freedom of association.

But who cares SJ? I like to see people in love, it makes me smile. I don't think there is anything wrong in limited public displays of affection. I am sure we have all kissed our SO's during a romantic dinner out. Love should make people happy, not make them sneer. If i see a couple obviously in love and being affectionate with each other, it always makes me smile.

How does someone openly flaunt their heterosexuality?

There is no such thing in the Constitution as freedom from religion.....but the very fact that you are not forced to practice a religion is your freedom from religion.
You moron. It is impossible, literally impossible, to have Freedom OF Religion unless you have Freedom FROM religion. I have the Constitutional right to be free FROM your religion, just as you have the constitutional right to be free FROM my religion. You literally can't have one without the other.

I'm reasonably sure that such a law would be struck down at the Federal level as being a violation of the Civil Rights Act of 1964. The only way such a law is even marginally legal is in regards to some private transaction but would be unlawful under federal law in regards to any kind of public accommodation.

And that law is contrary to freedom of association.

When you open a business you agree to certain conditions under the law. Sorry if you can't deal with that. Freedom of association is not about who you can do business with it is about who you can associate with and there have been numerous times in this countries history when private citizens have been seriously questioned under oath about who they associate with so I don't think that even applies anymore to tell you the truth. There are currently laws on the books saying no more than three people can associate on the street corner for instance. But since they are mostly used against black people I don't think many white people give a shit about them! Maybe you can start a movement to get those laws changed since you seem all worked up about this issue!

Those words aren't in the Constitution.
No they are not.....but they are bed rock liberal beliefs and they are certainly embodied in the 1st amendment, 13th, 14th, 15th, 19th, 24th and 26th ammendments. Do you have a problem with these bed rock liberal values expressed by the Declaration of Independence and these Constitutional Amendments or do you prefer your old world European values?

I'll go on record as stating I far more prefer these essential liberal American values to your old world European ones.

What does freedom of association mean to you?
LOL I should play your own dubious logic and ask you to show me where "Freedom of Association" is in the US Constitution. LOL

Freedom of Association has been defined by SCOTUS as the right to associate with others in pursuit of a wide variety of political, social, economic, educational, religious, and cultural ends. Freedom of association DOES NOT give you a right to discriminate against others on the issue of public accommodations. To equate the two would be a logical fallacy.

And you also have the right to be sued if your decision to not assist someone is based on arbitrary reasons.
No he's just simply factually wrong. He does not have the right under Federal law, to discriminate against anyone, in the area of public accommodations, based on their race, place of origin, religion, color, sex, sexual orientation or disability.

I know that is what I was alluding to.

Being in love is the best feeling in the world! :)
