First off, how could you think this guy is sane? Second, if found NGBRI he would have to spend time in a lock down mental facility until he was deemed no longer a danger to himself or others. John Hinkley has been in since he was found NGBRI. Which brings me to third point, RIGHT WINGERS HATE NGBRI. After Reagan was shot the move across the country by righties was to eliminate it.

Okay interesting, I didn't know that about Hinkley. So either way this guy isn't being released into the general public, which is all I care about. And I seriously don't know how anyone could believe the guy is sane. Just what he did, and look at him. Man if I saw that guy headed towards me on any street I couldn't run across the street fast enough.

It sounds like he could be released, but realistically, he wouldn't be.

Of course, but it does mean that once he is cured he'd be released. I think they are going to have difficulty proving he didn't know right from wrong.

Which IMO is a bullshit standard. When Abraham took Issac to the top of the mountain and sacrifice him, he KNEW what he was doing violated societies laws. Still up he and Issac went, and if the voices in Abe's head hadn't chimed back in at the last moment, Issac would be dead. What is right and wrong as nothing to do with what goes on inside a crazy person's head. The NGBRI standard in most states requires that the defendant be a blithering idiot. That is because we let blithering idiots with law degrees write our mental health codes and insanity laws instead of people who understand the intricacies of neuro-chemical imbalances and bad wiring.

He knew it was "wrong", that is the point. Had Abraham killed Isaac in CO today, he'd be standing trial for capital murder. He had to sneak behind his wife's back to do it, that is a clear indication that he knew he'd be stopped because what he was doing was wrong.

Rather than demanding applicants show their suitability to own firearms.
No buy is based on guilt.
Current law assumes guilt until otherwise proven!

Lots of mentally ill people know things are wrong but do them anyway. Down Syndrome kids KNOW things are wrong but but do them anyway. Compulsion will make people do things even when they know they shouldn't. That is antithetical to the deliberative mind, and as such shows mental disease or defect, ergo, lack of culpability.
