Ever since police unloaded 115 rounds into a car driven by 22-year-old Palm Beach man Raymond Herisse on Memorial Day weekend two years ago -- a firefight that wounded five bystanders and was caught on video -- a key question has been, What triggered that onslaught of firepower? Police waited days to announce they'd found a gun in Herisse's car, but did he start the barrage by firing at cops?

A newly released lab report strongly suggests Herisse never pulled the trigger. He tested negative for gunpowder residue on his hands, a key forensic clue in shooting cases, the Miami Herald reports.

The newly released report is public because Herisse's family and the innocent bystanders hit by police fire sued the department and accused them of dragging their feet on their investigation; a judge ordered some of the records from that investigation released last week.

The lab report contradicts then-Chief Carlos Noriega's story: After police found a Baretta 92-F in the backseat, he said, "We were told he discharged his firearm. Now we need to confirm that with ballistics."

But it likely won't change the department's justification for killing Herisse (who was later named a suspect in a Boynton Beach robbery). They say he tried to run down officers with his car, and using a vehicle as a weapon is considered sufficient provocation for police to fire in most cases.

Whether or not he fired, police union chief Sgt. Alex Bello tells the Herald, doesn't change the case. "Regardless of whether or not he had gunshot residue on his hands, the guy was clearly a threat in an automobile that can take out a bunch of people," Bello says.

several bystanders had cell phones recording this incident, they were then forced to turn over cell phones at gunpoint, which police summarily deleted or destroyed.

a WARRANT is required for cellphones containing evidence, unless that phone was used in the crime. These police are armed robbers at a minimum but will never be charged, since zappa says that is their job.
 
This is a tough one for me.

On one hand I am no fan of the police. On the other hand it is Palm Beach and they are too stupid to figger out how to vote.

because most people in this country are unable to stomach the idea that police are anything other than honorable and caring protectors of the community, therefore, they are willing to let some acts of bad police slide.

yes, it did. only because the individual hid the SD card in his mouth while the cop destroyed his cell phone.

Yup, it was a brave man. He saw those cops kill that guy, then they pulled a gun on him, stomped on his cell phone, then walked him to a police command center. During the walk, he took the SD card out of the phone and held it in his mouth. Then the cops confiscated the phone. It took two weeks to get them to return the phone.

perhaps the gun rights people think this guy should have used the gun he had to fight against the cops? Guessing the outcome would have been the same, but the cops then would never have been called on their brutality.

That is fucking incredible.

Video a cop committing a horrific, possibly criminal act .. get your phone destroyed .. or worse.
AND worse. the individual had just had his life threatened by a steroid hyped murderer holding a gun to his head, but because he wears a badge, he'll suffer no consequences.

Why hasn't the President weighed in like he did with Trayvon? Surely he doesn't have an aversion to commenting on the events of the day. Does Obama not think that this young man would look like his son if he had one? Do the dreadlocks make him look like an unsympathetic victim so therefore the liberal outrage is nonexistent? Do the cops not have jewish sounding names like Zimmerman?
