The Logic goes something like this... Use of word does not indicate a pattern of behavior that proves prejudice on his part. Such examples would be the comedic use of the word and the use of the word among african americans.

since we're all equal, in the eyes of the law, it would be impossible to consider it racist when uttered by anyone else then.

where does it say where are all the same race? equality under the law, does not mean i'm the same ethnicity or race as my neighbor. surely you've seen census forms.

again, being equal has nothing to do with race issues. one is the law, the other is personal. i'm allowed to hold racist views, however, i am not allowed to run a business open to the public, rent a house etc....based on racist views. there is a difference.
