Freedom of the press covers covering such controversial stupid laws. Waving around the magazine (clip is used to load a magazine, it isn't a magazine itself) is used as, specifically, political speech in this instance. Regardless that his opinion in undoubtedly opposite mine, if he gets arrested for this the circuit court will tell the cops to back off, and they'll do it quickly.

the first amendment does not protect you from committing a crime, however, in this instance, i can't imagine any judge (utilizing strict scrutiny) not finding that his actions are protected under the 1st.

it is contradictory. the courts bend over backwards for the 'press'. on the one hand, i can see how this is wholly unfair, on the other hand, i am glad they do so, as i cherish our press over any other countries press. they are far from perfect, however, by and large they are open and free to publish ideas, news etc that other countries cannot.

should he be bound the law. absolutely. the crime does not even require mens rea.

First, just an FYI. A clip is used to load a magazine, it isn't a magazine itself.

It depends on how it is used. If you, say, strap it to a sign protesting against more gun control it would be political speech, if you fill it with rounds and slap it into a gun, it isn't speech any longer and you'd be using a different Right.
