Obama to take legal action against CO and WA for voter approved MJ legalization

should he inforce federal law or not?

Isn't that his duty......?

Or is the oath to uphold the Constitution only for Republican Presidents ?

Of course, Obama has ignored and refused to enforce some federal law in the past....being the Messiah and all powerful and above the law.

And everybody was saying how Obama would be all good with this. He smoked his, now that he can't do it openly he doesn't want you to either.

He has not done anything yet. What a silly thing to say "now that he cant do it openly he doesen't want you to either."

Did you believe Bush should have legalized coke, or DUI because he once did it?

The Federal Law should be changed. The President should push Congress to change the Federal Law. However the Federal Law should be enforced as long as it exsists. Just because a President once broke the law 30 years ago does not mean it should be changed or that he can not support the law. That is just dumb.

Senior White House and Justice Department officials are considering plans for legal action against Colorado and Washington that could undermine voter-approved initiatives to legalize the recreational use of marijuana in those states, according to several people familiar with the deliberations.

Even as marijuana legalization supporters are celebrating their victories in the two states, the Obama administration has been holding high-level meetings since the election to debate the response of federal law enforcement agencies to the decriminalization efforts.

Marijuana use in both states continues to be illegal under the federal Controlled Substances Act. One option is to sue the states on the grounds that any effort to regulate marijuana is pre-empted by federal law. Should the Justice Department prevail, it would raise the possibility of striking down the entire initiatives on the theory that voters would not have approved legalizing the drug without tight regulations and licensing similar to controls on hard alcohol.

Some law enforcement officials, alarmed at the prospect that marijuana users in both states could get used to flouting federal law openly, are said to be pushing for a stern response. But such a response would raise political complications for President Obama because marijuana legalization is popular among liberal Democrats who just turned out to re-elect him.

“It’s a sticky wicket for Obama,” said Bruce Buchanan, a political science professor at the University of Texas at Austin, saying any aggressive move on such a high-profile question would be seen as “a slap in the face to his base right after they’ve just handed him a chance to realize his presidential dreams.”
Then he should take the lead in decriminalizing it but then the wing nuts would have a field day, wouldn't they?

he should deschedule it from the drug list.

I think that is the plan but they are waiting for something to do it.

I think its research results they are waiting for.

a whole new cash of research showing the good that MJ can do and the lack of harm it really presents
I agree. It's absolutely asinine that MJ is regulated with Hard drugs like Heroine, Cocaine and Meth. It's stupid.

MJ laws have little to do with the constitution. Other than the fact that it took a constitutional Amendment to do the same thing to beer that they do with MJ.

What you just said is just stupid. Which state passed laws that allowed those? Seriously, do you read what you "say" before you go ahead and submit it?

Which of those two admitted to doing cocaine? Which admitted to smoking dope like it was going out of style and was on sale?

This President won't. He's put more people in prison for legally (in their state) selling medicine than anybody ever has.

the entire controlled substances act is a violation of the constitution and commerce clause. so is the NFA.

This is a President who has prosecuted the war in such a way that were his name Bush, the left would be screaming for war crimes tribunals. This is a man who said he opposed the Patriot Act and then re-authorized it. This is a man who signed NDAA. He will push to have the federal courts nullify the Washington and Colorado laws. Now for you rightwingers, watch close as all those conservative "states rights" judges rule that the States of Colorado and Washington have no right to regulate marijuana usage inside their own borders. A pox on both your fucking houses.

I think you are bat shit insane. Obama doesn't care about potheads. He fooled them into voting for him twice, the 2nd time sending a fuck ton of them to jail. I bet he pisses himself with laughter every time a stoner defends him.

Your title is misleading. You seem to want Obama to take action. Are you really a libertarian or just a gun nut and a crank?

the executive branch has a wide degree of latitude on prioritizing their agenda. He can tell the DOJ to stand down. But yeah desh, maybe he should just ignore civil liberties and the will of the people. You are such a partisan hack.

Ehh, one could argue that by not enforcing federal law he is ignoring the will of the people. I am sure some of the religious reich will if the DOJ does not offer a rigorous defense of DOMA.

I think their is sufficient reason to be hopeful here. Tje politics around this issue have changed a lot in the last four years. Obama can't stop it and Co and Wa will be joined by others soon.
