Far as I know, courts convict people of breaking the law everyday, and NEVER excuse it because "damage is done!"

The damage is done, going after this person would make them look worse. What would be the purpose of prosecuting. Did they say no pictures or recordings? Public figures may have a hard time perusing this. I guess they will have to start collecting cell phones at the door of their secret secret fund raisers.
It would be interesting to know if the person that recorded Obama in 07 in SF talking about how those midwestern conservative cling to their guns, and religion was gone after...
