Pick it apart all you want. The point is that the law is flawed, which is why nutjobs get guns that way. Doesn't matter why it was written that way or that the writing was deliberate. Nutjobs getting guns as a result wasn't their intention, yet that's what's happening. The intention was to prevent that - yet it does just the opposite. Loophole. Call it whatever you want to. That's what it is.

Then please tell how a "nutjob" is going to be differentiated from someone who is NOT a "nutjob"?


And NO, it is not a "loophole"; no matter how many times you keep repeating it.
 
You can't test or tax a right. Settled that with poll taxes a few decades ago.

Well there's a big old nasty flaw, then. Too many nuts have guns. Now we know how that happened. ;)

And that's why Aurora incidents will continue. And people will continue to whine and act shocked over it when it's clearly to be expected, since nutjobs have gun rights.
 
I've really tried to avoid getting involved in this discussion, because I've heard it all before. Mass shootings happen in plenty of places. Had one in England last year or so. We all remember the ones in Norway. Laws in both are draconian compared to here, and somehow those didn't stop them from happening.

Wonder why, even though we had a higher rate of gun ownership in the 60's, we didn't have mass shooting? Institutionalization. But Kennedy ended that and no one has looked at it ever since. All this talk about knowing someone is crazy but not being able to do something about it goes right back to there. You want to fix a problem, punishing and restricting law abiding citizens isn't the answer. Making me jump through more hoops to buy guns legally will just make me buy them illegally or make them myself. It won't stop a damned thing.
 
Not 'damn people' - unstable people. But it's okay, expect more 'massacres'. I know we won't hear any whining about it from you - you're all for it. Right?

Oh I expect them all right. All the laws in the world wouldn't (and haven't) stopped them.

so you don't want stricter gun rights for all? just those you "know" are loose cannons?

The "licensed gun dealer" just has to get his "unlicensed" employee or a buddy to sell the guns. That's what the loophole is. der...

And what does he tell the feds, when his books are audited and he can't account for those guns he had his "unlicensed" employee or buddy sell; der..?

So only the unstable loose cannons will be restricted? And how will you identify them? Oh yeah, psych evals. I guess psych evals will now be part of the gun purchasing process? How many sessions will it require? 1? 5? Once a week for 2 years?

Well then here is the answer, a levy should be paid on every gun so that it can go towards the institutionalisation and all round better healthcare for the mentally ill.
