MORRISTOWN, N.J. - Lawyers for a New Jersey woman say the state's identity theft law doesn't apply to allegations that she created a fake Facebook profile about her ex-boyfriend.

Dana Thornton, 41, faces up to 18 months in prison if convicted.

Authorities allege the Belleville resident created a Facebook page as if it was written by her former boyfriend, Parsippany police Detective Michael Lasalandra, after they broke up.

what you think, should she be criminally responsible? i'm not sure it is identity theft, however, i haven't read their law, but usually ID theft is not to prevent this type of fraud....but i can see how this fraud is just as bad as representing you're that person offline. i wonder if the courts will apply this to legion type tactics...i doubt it, but you never know.

that right there is the ONLY fucking reason this is being prosecuted.

I think you'd lose, still, because Yurt is still technically an internet personality, and so you would be hard-pressed to prove personal injury occurred as a result.

i would lose, and stated that before when someone else brought up the issue, that is why i wonder if they courts will apply it, i doubt they will, but you never know. you're correct in your analysis.
 
I think what I'm hitting at is that if this case sets a precedent for you to utilize, the rationale for why you still would lose in court is built around what I stated before.
