nov 11 2016 West Virginians can be charged with drunk driving on their own private land, even if they represent no danger to others. The state Supreme Court of Appeals laid down this new precedent last month, overturning previous interpretations of the state’s driving under the influence (DUI) law.

“We hold that an individual may lose his/her driver’s license if they are found driving a vehicle anywhere within the physical boundaries of West Virginia while under the influence of alcohol (and/or drugs), even if the vehicle is driven only upon private property not open to the general public,” Chief Justice Menis E. Ketchum II wrote for the court.

The ruling does not just apply to automobiles driven on one’s own land. The high court reviewed the situation of Joshua D. Beckett, who was arrested on February 4, 2012 for riding an all-terrain vehicle on his family’s farm in Monroe County. Having had a bit too much to drink, Beckett crashed his ATV and a friend called 911 for help. The medical personnel who responded to the scene called the sheriff after noticing Beckett was tipsy and had a blood alcohol level of .17.
 
So I can still drive from my bro's house after beers since we share a private road lol?

I hate drunk drivers but if you're on your own land.....

Anyway, if west virginny needs this law, it should be written by the legislature.
 
I can drive shitfaced on my land but I cannot be shitfaced in my boat on my private pond.

Truth: Let's see how quick the american communist lawyer union (ACLU) comes to the aid of this egregious act of CHANGING EXISTING LAW and ignoring decades of standing legal precedence..i.e., legislating law from the bench. The WV supreme based their decision on precedence established by other states....

This would be the perfect case to bring before a TRUMP SCOTUS....were constitutionalism might be invoked instead of judicial activism. I was not surprised that such idiotic laws already exist in other states..... considering the sources of those laws. Not coming from acts of legislation but coming from the sound of some radical judges gavel.

Is this surprising? Hardly. Its just another case of LOST LIBERTY. The more you legislate...the more you dictate (even from the bench). There might as well not be a US CONSTITUTION if it can be changed void of legislation...the keys to the kingdom have clearly been stolen by edict of oligarchical proportions found to exist by simple civil service employees. Today....its our property rights they are coming after...tomorrow it will be your guns, then your freedom, all in the name of SOCIAL JUSTICE.
