I think it was a dumb idea to keep him off the ballot, absent a criminal conviction related to insurrection

The provision is so vague, there has to be some official procedure to determine if a person participated in an insurrection. That is why it gives Congress the power to make legislation determining the procedures to be followed.

I don't think it has to be a criminal conviction. I believe most of the people "charged" under the act were removed from Congress under the power of each house to remove members by a 2/3 vote for being in the Confederacy. It didn't involve criminal conviction but an official body did determine if they person was in an insurrection.

Congress passed a law. If he were actually convicted of Insurrection (a felony crime under 18 U.S. Code § 2383 - Rebellion or insurrection) you would have my wholehearted support to remove him from ballots, and likely the same from SCOTUS... the decision on whether someone has committed a federal crime is never decided in civil courts in any state venue.

However, they didn't even bring him up on such charges, likely because there is no real supporting evidence of his active participation in an Insurrection and even the partisan hack Merrick Garland knows he couldn't win in court.
 
I don't disagree with the decision. I DO agree with the consenting opinion written by the three 'liberals' and Barrett. There should be another mechanism for bringing an action to remove someone from the ballot. Leaving this to Congress given the current climate, and you know damn well they won't pass a thing. Even though that's their job. I guess as of now, Congress has laws to support most of the 14th, but not this section. They should pass it tomorrow. They won't.
