Supreme Court has voted to overturn abortion rights, draft opinion shows

"We hold that Roe and Casey must be overruled," Justice Alito writes in an initial majority draft circulated inside the court.

The Supreme Court has voted to strike down the landmark Roe v. Wade decision, according to an initial draft majority opinion written by Justice Samuel Alito circulated inside the court and obtained by POLITICO.

The draft opinion is a full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional protections of abortion rights and a subsequent 1992 decision – Planned Parenthood v. Casey – that largely maintained the right. “Roe was egregiously wrong from the start,” Alito writes.

About damn time! This is a state issue, not a federal one. There will be plenty of states you can go to to get an abortion regardless. There is no need for a federal law on this.

Agree about states' rights, but Roe was based on the Constitution and not federal law.
 
No, Roe was made up out of thin air. There is nothing in the Constitution you can point to giving anyone the right to an abortion.

Well, the Supreme Court found it. They said the 9th Amendment includes the right to privacy (established in Griswold v. CT) and the 1st (assembly), 3rd (quartering troops), 4th (search) and 5th (incrimination) illustrate the founders meant to protect privacy. A decision between a woman and her doctor about abortion are covered under the right to privacy.

Thus, the Supreme Court made it a constitutional right (whether we agree or not).

It's more than that. It's not only that abortion SHOULD be left to the states. It's also that the constitution says it's a state issue. The tenth amendment.
 
The other side of this coin is that any state that allows abortion must also ban forced child support by men. If the decision to live is hers and hers alone, then she has to accept the consequences.

Those are absurd fig leaves for legislating from the bench which is what the Warren court did in the Roe v. Wade ruling. By the above legal reasoning, assisted suicide, or any other absurd or questionable procedure would be legal. Clearly that's not the case. These are state's issues not federal ones.
If state A wants abortion on demand, fine. If state B wants to outlaw it, fine. If you want an abortion, go to state A and get it. No big deal.

Republicans don't need big gains to win the House since there is only about a six member majority.

It takes away an important reason for the one-issue voters to vote Republican. I saw a discussion by Republican consultants who agreed losing abortion as an issue would take away an important weapon.

True, but we both know liberals and conservatives want government to do things not in the Constitution. It gives Congress the power to pass naturalization laws but there is no power to control immigration (although almost all of us favor such laws).

The MS law being ruled on prohibits abortion after 15 weeks. About 96% of abortions are performed before this time.

What's even funnier, is that the asshole who leaked it almost certainly expected a shit storm of opposition to arise immediately afterward. Instead, it's mostly been a non-issue and ignored. I bet they're freaking out worse about how their radical Leftist views aren't being taken seriously...
