Musk has already lost. Twitter, and just about everyone else, told him this was a bad deal. He forced the management to sell, and then saw confidence in all his ventures drop. He has lost billions, and so decided to try to get out. The best he can hope for is to only lose a few billion more.
To get out of the contract, he has to prove that he has gained knowledge that was covered up before. He has to prove they were trying to trick him into buying the company they tried so hard to prevent him from buying. It is a tall ask.
