Long before then, those pushing the long shot plan knew they stood on shaky ground, the Times reported. People familiar with the plan at the time have told The Arizona Republic that while the strategy was legally questionable, they didn't view their activity as criminally wrong.

“We would just be sending in ‘fake’ electoral votes to Pence so that ‘someone’ in Congress can make an objection when they start counting votes, and start arguing that the ‘fake’ votes should be counted,” wrote Jack Wilenchik, a Phoenix lawyer who helped convene the Trump electors for Arizona.

The Dec. 8, 2020, email went to Boris Epshteyn, an adviser to Trump's campaign who served as a bridge between the Trump campaign and John Eastman, a California law professor who helped devise the legal strategy.

In a follow-up email, Wilenchik wrote that “‘alternative’ votes is probably a better term than ‘fake’ votes,” the Times reported Tuesday.

Wilenchik also seemed to acknowledge in an email that they should submit the fake electors "even though the votes aren't legal under federal law — because they're not signed by the governor."

“Kenneth Chesebro, a lawyer working for Mr. Trump’s campaign, wrote in a Dec. 11, 2020, email to other members of the legal team that [two women listed as Trump electors if Trump had carried Arizona] had raised concerns about casting votes as part of an alternate slate of electors because there was no pending legal challenge that could flip the results of Arizona’s election.”

The women, Arizona Republican Party Chairwoman Kelli Ward and Republican state Sen. Kelly Townsend, were “concerned it could appear treasonous for the AZ electors” to go along with the plan to cast electoral votes for Trump since Arizona had been called for Joe Biden and the women had seen no evidence that Trump had actually won.

Chesebro wrote the word “treasonous” in bold in his email.

The Times story noted that “One person working on the plan, the Arizona-based lawyer Jack Wilenchik, conceded in emails that the Electoral College votes the campaign was working to organize ‘aren’t legal under federal law’ and repeatedly referred to them as ‘fake.’”

Townsend ultimately refused to sign the document stating that Trump had won Arizona. Both she and Ward have received subpoenas to be questioned about the scheme. Neither of them spoke to the New York Times for the story from which this post is derived. Townsend was a candidate in the 2022 Republican primary for Arizona's 6th congressional district before dropping out in March 2022 after failing to receive the endorsement of Donald Trump.[75]

In 2022, Townsend claimed she gave up the Congress race and a much coveted Trump endorsement to fight Wendy Rogers for an Arizona Senate seat.[76][77] Townsend lost the August 2022 District 7 State Senate primary to Rogers by a 59.7% to 40.3% margin.[78]
