As the NYS AG cases continues against Trump Org, DJT and Eric and DonJr, we see them one by one using a version of the Dummy Defense.
That is to say 'I know nothing and just relied on outside experts and thus am not at fault'.
We have Eric and DonJr being shown all the Financial forms and other statements they signed off on as Fiduciaries or Officers of the company claiming no knowledge of what was being said or represented ('the fraudulent statements') and saying they just signed what the Accountants, they trusted put in front of them. Thus 'blame the banks and do not blame us'.
BUt that is not how being Fiduciary or Officer works. You provide the experts the data, and the experts rely on what you provide them being Correct, Honest and Full some, and the Experts take that data and give you back Statements for filing. You are then OBLIGATED to understand what you sign before dong so and filing it. If that requires you sit for hours with the Accounts (experts) and have them explain exactly how things were determined, then you do it.
That means, when you submit the signed doc's, you are doing so saying 'I Eric/DonJr understand and verify these docs we, the Company are submitting and are doing so based on OUR knowledge and NOT simply based on what some outside expert told me'.
So there is simply no defense to the types of corporate fraud they are cited with by saying 'not my fault... i trusted experts'.
And if Donald Trump takes the stand and offers a version of this same defense, that is exactly why Trump Org was a fraudulent org that NEEDS to be shut down. Not a single officer or fiduciary in the company who CAN or WILL ever do the work, and take responsibility for anything the company files EVER.
That simply is NOT a defense and any corporation anywhere in the US whose fiduciaries and Officers say 'we do not understand and take no responsibility for any filings' SHOULD be shut down instantly as that is commiting a fraud to sign and submit those doc's, if true.
