this will be no different than the bush admin arguments about legal counsel advising something, even in direct contradiction to the constitution. Obama has plausible deniability now.

It's all part of Obama's grooming for leadership of the New World Order. A take-charge type of guy. :)

"plausible deniability" is exactly the opposite of your perception....Obama was advised of something being illegal and can't deny not knowing that....
 
Actually, Obama is correct, and has several SCOTUS cases which agree with him. It was settled way back at the start of the Civil War that the President, as commander in chief, has full authority to deploy military force where ever he sees the potential for a threat. This authority has been upheld in several subsequent challenges. That is why Congress was unable to put a stop to Vietnam, even when a veto-proof bi-partisan majority in congress desired to do so. And while I strongly dislike the idea of one man having that much authority, the fact is, under current Constitutional framework, he does. The reason: military action is, by definition, military, while the act of declaring war is a political action. They are distinct, and separate (though related) powers which were granted separately to the different branches of government.

Also, while Congress does control the purse strings of the military, they do not have the authority to pull funding for specific military actions. (ie: they cannot say "yes, you can still pay the soldiers in Afghanistan, but you can't buy bombs for attacking Libya.") They can only defund the military as a whole to have any effect on the ability of the military to conduct operations ordered by the CinC.
