The Appointments Clause allows Congress to vest the appointment of "inferior officers" in the President, the Courts of Law, or the Heads of Departments. The definition of "inferior officer" is based on the importance of the officer's responsibilities, the limited nature of their duties, and the narrowness of their jurisdiction.

Congress has not empowered the DOJ to appoint inferior officers. They have empowered the Department of Energy and a few other departments like HHS with the power to appoint inferior officers. Sack Smith is an inferior officer and his position has not been authorized by Congress. Everything that Jack Smith is doing is unconstitutional and thus illegal.
 
Trump set the precedent that he would fire Senate appointed executive branch officers, and just promote one of his lackeys to the position on an interim basis, and never go back to the Senate to confirm a replacement.
