Sen. Susan Collins, R-Maine, on Friday suggested that conservative Supreme Court Justices Brett Kavanaugh and Neil Gorsuch broke a promise they made to her after both ruled in favor of overturning Roe v. Wade, the watershed 1973 ruling enshrining America's constitutional right to abortion.

"This decision is inconsistent with what Justices Gorsuch and Kavanaugh said in their testimony and their meetings with me, where they both were insistent on the importance of supporting long-standing precedents," she told CNN.

She also added that "throwing out a precedent overnight that the country has relied upon for half a century is not conservative. It is a sudden and radical jolt to the country that will lead to political chas, anger, and a further loss of confidence in our government."

At the time of his confirmation hearing in 2017, Gorsuch said: "I would tell you that Roe v. Wade, decided in 1973, is a precedent of the United States Supreme Court. It has been reaffirmed. A good judge will consider it as precedent of the U.S. Supreme Court worthy as treatment of precedent like any other."

Kavanaugh in 2018 made similar remarks in his confirmation hearing.

"It is settled as a precedent of the Supreme Court, entitled the respect under principles of stare decisis," he said. "The Supreme Court has recognized the right to abortion since the 1973 Roe v. Wade case. It has reaffirmed it many times."

Carefully prepared responses to the biggest question they knew was coming. Neither is an explicit promise not to overturn. Collins should have pressed Kavanaugh on that. Instead she let it go and took it as cover for herself in voting to confirm.
