This guy worked hard to overcome dyslexia and score better on the test than his latino and african peers. Then the employer pulled the rug out from under the feet of the white folks because the majority of their peers from differing racial groups did not pass the test.

Here's part of the majority argument.

....employers have made clear their selection criteria, they may not then invalidate the test results, thus upsetting an employee's legitimate expectation not to be judged on the basis of race...
 
If this is true and she doesn't ask them to back off, this won't end well.

Why would they do this?

WASHINGTON - Republicans announced yesterday that they plan to call a white firefighter, whose reverse discrimination claim was rejected by Supreme Court nominee Sonia Sotomayor, to testify against her, hinting that they will try to make racial bias a central theme of the confirmation hearings that open Monday.

Firefighter Frank Ricci of New Haven, the lead plaintiff in a lawsuit challenging his city's decision to scrap the results of a promotion test because too few minorities scored highly enough to qualify, was one of 14 witnesses on the GOP list. Sotomayor, who would be the first Hispanic on the high court, was part of an appellate court panel that rejected Ricci's claim. The Supreme Court reversed the ruling last week.

At the Senate Judiciary Committee hearings, Republicans also plan to call Sandy Froman, a former president of the National Rifle Association, which has criticized Sotomayor's views on gun ownership rights, and Charmaine Yoest, president of Americans United for Life, a Washington-based group that opposes abortion...
 
Two wrongs don't make a right. The firefighter is not a nominee and sending the press after him only cements a lefty relationship between reporters and one of the political parties.

It wouldn't be wise to have it out that you sent the media after a citizen who you ruled against as a judge.

You do know the side I'm on, right? LOL!
