Ohio McDonald's gives voting advice in paychecks

By JULIE CARR SMYTH COLUMBUS, Ohio - A handful of McDonald's employees in northeastern Ohio received handbills in their most recent paychecks suggesting they vote for three Republican candidates.
"If the right people are elected we will be able to continue with raises and benefits at or above our present levels," the insert said. "If others are elected we will not."
The fast food chain's corporate headquarters in Oak Brook, Ill., quickly condemned the action by Canton franchisee Paul Siegfried, saying it violated company policy. Secretary of State Jennifer Brunner, the Democratic elections chief, said she was launching an investigation because the action appeared to violate Ohio election laws.
Allen Schulman, an attorney representing one of the employees, said Friday he had forwarded the paycheck insert to Canton's city law director, citing state and federal laws against corporate advocacy in elections.
"It's no surprise to anyone that Ohio is a battleground state in this election, and for a multinational corporation like McDonald's to threaten employees like this is morally and legally wrong," Schulman said in a statement.
Siegfried issued an apology later Friday, emphasizing the value he places on employees and their freedom of choice in the upcoming election.
"Distributing this communication was an error of judgment on my part," Siegfried said in a statement. "Please know, it was never my intention to offend anyone. For those that I have offended, I sincerely apologize."
The handbill with a simple McDonald's logo at the top recommended votes for Republicans John Kasich for governor, Rob Portman for U.S. Senate, and Jim Renacci for Ohio's 16th congressional district. A Renacci campaign flier was also included.
Shirley Rogers Reece, general manager for the company's Ohio region, said McDonald's had no knowledge that the handbill was being distributed.
"We wholeheartedly respect diverse views and opinions, and our employees' right to vote," she said in a statement. "Our position is that every employee should make his or her own choice."
Shulman told city law director Joe Martuccio the letter was "clearly designed to intimidate, threaten and coerce a captive group of employees to vote for specific candidates at the risk of their jobs, their raises, and their benefits."
He called it "particularly egregious that in this time of harsh economic conditions, a corporation would stoop to this level of voter intimidation."
In her statement, Reece said that McDonald's did not endorse any of the candidates mentioned in the handbill.
"While clearly this was poor judgment, we don't believe it was intended to offend anyone," Reece said.
Kasich faces Gov. Ted Strickland in Tuesday's election. Portman is running against Lt. Gov. Lee Fisher for the open seat currently held by U.S. Sen. George Voinovich. Renacci is challenging first-term Rep. John Boccieri in one of the most closely watched congressional races in the country. Strickland, Fisher and Boccieri are all Democrats.
Brunner said her office would investigate the letter and hand off findings to the state attorney general.
"Voter intimidation is a form of voter fraud. It is a serious offense requiring a strong response," she said in a statement.
She also issued an overall warning to the state: "The election is just four days away. All involved would be best to play fair, fight hard for what they believe in and work together for all Ohioans and our country in this democratic process not enjoyed in countries elsewhere."

Nevada voting machines automatically checking Harry Reid's name; voting machine technicians are SEIU members

Clark County is where three quarters of Nevada's residents and live and where Senate Majority Leader Harry Reid's son Rory is a county commissioner. Rory is also a Democratic candidate for governor.

Since early voting started, there have been credible reports that voting machines in Clark County, Nevada are automatically checking Harry Reid's name on the ballot:

Voter Joyce Ferrara said when they went to vote for Republican Sharron Angle, her Democratic opponent, Sen. Harry Reid's name was already checked.

Ferrara said she wasn't alone in her voting experience. She said her husband and several others voting at the same time all had the same thing happen.

"Something's not right," Ferrara said. "One person that's a fluke. Two, that's strange. But several within a five minute period of time -- that's wrong."

A Virginia Democratic organization appears to have violated federal election law by offering free beer to voters.

The Arlington Young Democrats held a happy hour last week at which they offered "a free drink and some appetizers" to anyone who brought an "I Voted" stick to prove that he or she had voted early in Virginia, according to a flier.

"In elections in which federal candidates are on the ballot, no one can offer any kind of benefit or reward for voting. The simple way to deal with this is to open up the event to all comers — voters and nonvoters alike," Loyola Law professor and election law expert Rick Hasen wrote POLITICO in an e-mail. "This is a very common problem, because people believe they are doing their civic duty by encouraging other people to vote. And in many states, in elections when federal candidates are not on the ballot, this activity is perfectly legal."

Corporations such as Starbucks and Ben & Jerry's ran afoul of this law in 2008 and complied by offering freebies to everyone rather than just voters.

I agree with you that it was a sleazy thing to do on the part of the franchise owner. (Incidentally, I also agree Dixie is strange, but that's a discussion for another time). Anyway, with that established, do you also agree it's sleazy when labor unions pressure or even harass members to vote Democrat? Reason I ask is this occurs to my dad every election cycle...

i do not care who interferes with the election process, it is wrong to do it

corporations want reps in charge and unions want dems in charge

banding together with like thinkers seems to be the way humans like to do things

before long, i suspect that elections will take place via the internet with individuals voting for a candidate and funding said candidate

i would like to see full disclosure of funds contributed to politicians and funds used for any political purpose

hidden sources of money are not the democratic way - if you support someone or something, come forward and say so

your ballot may be secret, but not your money

perhaps even more radical, i would like to see the end of political parties, but that is for another thread

Corporations do this shit all the time and get away with it. My company invited Rob Portman to our campus and allowed him to give a speech in our auditorium in which we were encouraged to attend. They did not, however, invite Lee Fisher.

Well let's keep things in perspective. This is McDonalds and even though this particular incident was the action of a renegade franchise owner it doesn't change the fact that this is still McDonald's and I'm sure the over whelming majority of their employees would say "Ya'll don't come even remotely close to paying me enough to influence my vote!" LOL Meaning I think his efforts were probably futile. Still, the law is the law and it appears this franchise owner may have crossed a line.

Voter intimidation, by any group or individual, is illegal. Period! It doesn't matter if it's done by big city party machine Democrats or if it's done by Corporatist Republicans. It's against the law.

A few things Dixie. On the first article. Early voting isn't done by machine anywhere in this nation. Early voting is done everywhere by paper ballot.

On the second Article. There is absolutely nothing wrong with Boxer, or any politician, Republican or Democrat, asking students to become involved in public affairs, up to and including supporting a candidate. As long as it is not done by coercion and why shouldn't the active students receive extra credit?

The Cincinnati situation actually occurred. Those responsible should be disciplined or terminated.

The Acorn account is more right wing bullshit and has all ready been discredited.

Yeah, I am really weird... for some strange reason, Democrats rigging voting machines, giving students "extra credits" to work campaigns, registering voters from vacant lots, giving voting age students Democrat-only ballots, and free beer, is a little more nefarious than putting a plug for a campaign in your paycheck. I guess I should be "normal" and just accept that Democrats get to cheat any way possible to win, while Republicans should have their free speech silenced. I guess I must have been dropped on my head or something, because I always thought our elections should be legitimate and fair, and not slanted heavily to the advantage of Democrats through fraud.

Allen Schulman, an attorney representing one of the employees, said Friday he had forwarded the paycheck insert to Canton's city law director, citing state and federal laws against corporate advocacy in elections.
"It's no surprise to anyone that Ohio is a battleground state in this election, and for a multinational corporation like McDonald's to threaten employees like this is morally and legally wrong," Schulman said in a statement.
Siegfried issued an apology later Friday, emphasizing the value he places on employees and their freedom of choice in the upcoming election.
"Distributing this communication was an error of judgment on my part," Siegfried said in a statement. "Please know, it was never my intention to offend anyone. For those that I have offended, I sincerely apologize."
The handbill with a simple McDonald's logo at the top recommended votes for Republicans John Kasich for governor, Rob Portman for U.S. Senate, and Jim Renacci for Ohio's 16th congressional district. A Renacci campaign flier was also included.
Shirley Rogers Reece, general manager for the company's Ohio region, said McDonald's had no knowledge that the handbill was being distributed.
"We wholeheartedly respect diverse views and opinions, and our employees' right to vote," she said in a statement. "Our position is that every employee should make his or her own choice."
Shulman told city law director Joe Martuccio the letter was "clearly designed to intimidate, threaten and coerce a captive group of employees to vote for specific candidates at the risk of their jobs, their raises, and their benefits."
He called it "particularly egregious that in this time of harsh economic conditions, a corporation would stoop to this level of voter intimidation."
In her statement, Reece said that McDonald's did not endorse any of the candidates mentioned in the handbill.
"While clearly this was poor judgment, we don't believe it was intended to offend anyone," Reece said.
Kasich faces Gov. Ted Strickland in Tuesday's election. Portman is running against Lt. Gov. Lee Fisher for the open seat currently held by U.S. Sen. George Voinovich. Renacci is challenging first-term Rep. John Boccieri in one of the most closely watched congressional races in the country. Strickland, Fisher and Boccieri are all Democrats.
Brunner said her office would investigate the letter and hand off findings to the state attorney general.
"Voter intimidation is a form of voter fraud. It is a serious offense requiring a strong response," she said in a statement.
She also issued an overall warning to the state: "The election is just four days away. All involved would be best to play fair, fight hard for what they believe in and work together for all Ohioans and our country in this democratic process not enjoyed in countries elsewhere."

I agree with you that it was a sleazy thing to do on the part of the franchise owner. (Incidentally, I also agree Dixie is strange, but that's a discussion for another time). Anyway, with that established, do you also agree it's sleazy when labor unions pressure or even harass members to vote Democrat? Reason I ask is this occurs to my dad every election cycle...

Corporations do this shit all the time and get away with it. My company invited Rob Portman to our campus and allowed him to give a speech in our auditorium in which we were encouraged to attend. They did not, however, invite Lee Fisher.
When I worked for National Bank of Alaska they brought Don Young in to speak with us, but we never heard from the Democratic candidate!
They also pushed us real hard to contribute to the United Way!
