This happened in California. If the cop thought he was drunk he'd have given him a breathalyzer test, then issued the formal ticket. Once that happens, if found guilty, it doesn't matter who's fault the accident was, Pelosi's hubby is now convicted of DUI and is automatically responsible under California law. He could have been rear ended and if found guilty of DUI the accident becomes his fault.
