So Pam is desperately trying to say to the judge 'my name is now on Lindsay's work, even if retroactively, so do not throw out the cases even if you kick Lindsey'.

But here is the big problem. The judge in trying to review this motion, including the request by the defense lawyers that the judge review all Grand Jury material to ensure honesty (something they rarely do as they typically assume honesty) demanded the ENTIRE grand jury file to review, and what Lindsey then handed in the transcript it was missing over 2 hours of time where the grand jury was in session.

It certainly appears that Trump DoJ does not want the judge to hear or read what Lindsey said to the grand jury. And if the judge insists on getting it, or then calls in the court reporter to ask where is the transcript or tape for those two hours, then Trumps DoJ either produces it or they are big, big trouble.,

If the court reporter does not have that two+ hours, that would only happen if Lindsey told her they were done for the day and sent her home, telling her she was just going to send the Grand Jury home and then she went in and spoke with them for 2 hours, gaining the Comey indictment.

Whatever happened her Bondi now owns it. She submitted to the court, she reviewed it all, including Grand Jury submissions and stands behind them all which put her as much on the hook as the other prosecutors signing Bill Essasyli submission are, which is why that case can go forward.

And while i am not saying anything will happen to her during Trump's term, the next DOJ could investigate her for charges (Trump will give her a pardon first) and she could lose her law license by being disbarred.

Not a lawyer but seeing Pammi disbarred would be sweet justice and another shit-stain on the Trump administration.

This case gets worse and worse for Halligan and Bondi.

There are ~2 hours of Grand Jury transcript (recordings) missing or never recorded. The betting line right now is on 'never recorded' with the thought being Halligan sent the Court Reporter home, making it seem like they were done for the day and then went back in alone for another 2 hours.

The Judge has been careful to not accuse them of that, at this point, but in the judge insisting on the transcript or recording, and if the DoJ fails to provide it, next steps would be for the Judge to demand the Court Reporter appear before her and explain what was done.

The expectation is that to avoid this, and PROOF that Halligan broke serious Grand Jury rules (a crime) that the DoJ may have do dismiss this and the James cases entirely. That Bondi signed on to all this retroactively that she was personally taking responsibility for EVERYTHING Halligan submitted and specifically the Grand Jury material which Bondi said she had reviewed and are accurate, in an attempt to not have the judge kick the case, if Halligan was kicked, Bondi now owns any misconduct Halligan may have done.




Judge Rules Trump Admin ‘Misconduct’ May Have ‘Tainted’ the James Comey Case in Scathing Order

In Monday’s order, magistrate judge William Fitzpatrick ordered prosecutors to immediately turn over records of secret grand jury proceedings to Comey’s defense.

“In so finding, the Court recognizes this is an extraordinary remedy, but given the factually based challenges the defense has raised to the government’s conduct and the prospect that government misconduct may have tainted the grand jury proceedings, disclosure of grand jury materials under these unique circumstances is necessary to fully protect the rights of the accused,” Fitzpatrick wrote in his 24-page opinion after he personally reviewed the grand jury transcripts....

Fitzpatrick wrote that the prosecution made two problematic statements to the grand jurors “that on their face seem to appear to be fundamental misstatements of the law that could compromise the integrity of the grand jury process.”


One particular statement “is a fundamental and highly prejudicial misstatement of the law that suggests to the grand jury that Mr. Comey does not have a Fifth Amendment right not to testify at trial,” Fitzpatrick wrote. “The prosecutor’s statement ignores the foundational rule of law that that if Mr. Comey exercised his right not to testify the jury could draw no negative inference from that decision.”


The DOJ has until 5 p.m. Monday to turn over audio recordings of the grand jury proceedings to defense counsel, CBS News reported.
 
If the Comey case is kicked, with or without prejudice they cannot bring this case again due to the Statute of Limitations lapsing.

If the James one is not dismissed without prejudice and can be brought again, James would have a good case to continue to push to get the judge to review the Comey Grand Jury files as well as the judge putting the James Grand Jury submissions under a microscope.

@T. A. Gardner likes to pretend that 'they will take a plea deal as the DoJ has a 90+ conviction rate' and most cases settle (true), but as i said to Terry, this is the Trump DoJ and they are stupid and inept, so the history of the department is irrelevant. Trump's DoJ is already falling to secure Grand Jury indictments at a rate never before seen, making the 'ham sandwich' say 'can't touch this'.

But because Terry is also stupid he will not make this connection and keep repeating competent DoJ rates.
 
Bondi said she read the transcripts. The judge was pissed off because they do not exist. The truth and justice have nothing to do with her. The case should be tossed and Halligan and Bondi should face bar charges.
Bondi made a legal representation to the Court, because it was becoming increasingly clear Halligan was going to get kicked off this case and since there was no other attorneys on the Indictments, that would then void them.

When Trumps other US Attorney in California got kicked off his 3 cases, for the same illegal appointment issues, the Judge stated he would allow those cases to continue since there were other junior lawyers signed on to all three Indictments, so they could continue to stand behind them.

Bondi was trying something that has no precedent in history and saying 'after the fact' that she is willing to sign on to all the material Halligan submitted, including the GJ material, and stipulated to the court she had reviewed them all and stands behind them. That is an under oath presentation to the court.

And if 2+ hours of grand jury transcript or recordings are not present in the court now, either Halligan and Bondi must now turn them over, or be exposed if they do not exist as Halligan sent the Court Reporter home and continued with out her. Bondi is fucked along with Halligan if that happened. Almost certainly will see her bar license gone and may face prosecution at the end of her term, until Trump pardons her.
