Palestine takes US to International Court of Justice over Jerusalem embassy move

The Palestinian authority has asked the International Court of Justice to compel the US to shut down its embassy in Jerusalem, because it violates the Vienna convention, which says an embassy must be located in a host country.
The Palestinian government submitted its application to launch proceedings against the US on Friday. The 14-page complaint, released by the UN's principal judicial body, alleges that the US, as a party of the , has flouted its obligation by setting up an embassy outside the territory of the host state, Israel.

It points out that, in accordance with the 1947 UN Plan for Palestine and numerous subsequent UN resolutions to the same effect, Jerusalem should be placed under an international regime as a "separate body" or "corpus separatum." Instead, Israel illegally took control over Jerusalem by "use of force" and a series of legislative and administrative means "in an attempt to annex the city." Thus, the US had no right to open its embassy there.

"The relocation of the United States embassy in Israel to the Holy City of Jerusalem constitutes a breach of the Vienna Convention on Diplomatic Relations of 18 April 1961."

The Palestinian suit is calling on the court to declare the US embassy move in violation of international diplomatic law and order Washington "to withdraw the diplomatic mission" from the city.

The Palestinian case is iron-clad under international law. Jerusalem is not Israeli territory and embassies must be located in the host counry.
Trump's recourse is to refuse to recognize international law and share fleas with the neoZionist dogs. However, ignoring the 1961 Vienna Convention on Diplomatic Relations will not turn out well for the US as it is party to it.

How were the Palestinians ever allowed to put Israel and the US in this nut-cracker ? They became entitled to access the international court when Palestine was recognised by UNESCO. The US response was to abandon UNESCO and pass internal laws to withdraw aid to Palestine if it ever accessed the courts. A bully on the ropes.
Palestine also became a UN-recognised observer state in 2012- despite churlish US opposition- thus cementing its rights to justice and all its privileges under UN-membership and international law. It lodged complaints against Izrael with the UN Human Rights body. In another churlish reaction Trump withdrew the US from the UN Human Rights body. A bully on the ropes.

US says Palestine ‘not a state,’ withdraws from Vienna Convention’s ‘optional protocol’

The US is withdrawing from the "optional protocol" in the Vienna Convention on Diplomatic Relations, John Bolton has confirmed. He said it follows a case brought by Palestine, challenging the US embassy's move to Jerusalem.
"I am announcing that the president has decided that the United States will withdraw from the optional protocol and dispute resolution to the Vienna Convention on Diplomatic Relations," Bolton said.

"This is in connection with a case brought by the so-called state of Palestine, naming the United States as the defendant, challenging our move of our embassy from Tel Aviv to Jerusalem."

The decision will see the US opting out of having to attend the International Court of Justice in the case of disputes, as outlined in Article I of the "Optional Protocol Concerning the Compulsory Settlement of Disputes."

"Disputes arising out of the interpretation or application of the Convention shall lie within the compulsory jurisdiction of the International Court of Justice and may accordingly be brought before the Court by an application made by any party to the dispute being a Party to the present Protocol," Article I states.

So.......the mighty United States of America... the most militarily- powerful state on earth- has turned tail and skidaddled at the first sign of an international legal challenge to its illegal movement of its embassy outside of the legitimate borders of Izrael.
' Shoot the messenger ' has long been the mantra of ignorant Americans who have been deceived into paying for Izraeli fascism. ' Shoot yourself through the head ' is a new one to me.

Yet again blind support for Izraeli criminality has diminished America's stature and weakened American political power abroad. It is not beyond the realms of possibility that Izrael will drag America into a major conflagration in which YOU and yours will die. For what ?
