Today, President Obama’s belief in a “living Constitution” came up against a ruling that enforced our fixed Constitution. A 3-judge panel of the U.S. Court of Appeals for the D.C. Circuit unanimously declared Obama’s “recess” appointments to the National Labor Relations Board to be unconstitutional.

The judges observed that no president from George Washington through Abraham Lincoln ever attempted to make an “intrasession” appointment (that is, an appointment when Congress was in session) without the advice and consent of the Senate, as Obama attempted to do. From the end of the Civil War through the end of World War II, only three such appointments were attempted. In the judges’ words, “t is well established that 80 years after the ratification of the Constitution, no President [had] attempted such an appointment, and for decades thereafter, such appointments were exceedingly rare.”

Doesn't sound like he was making recess appointments, because the selections for that board were made while Congress was in session. There is nothing wrong at all with recess appointments. What he was doing was appointing people without letting the Senate vote, while it was in session. I don't even know why the fuck they are calling that a recess appointment!

"Recess" is in quotes. that's basically the whole point of the court decision. The court disagreed with obamas definition of a "Recess" appointment.
 
Ah, I see. That's pretty hilarious that he would try to call them that. I take it the media didn't call him on it until the Court ruling?

"White House press secretary Jay Carney said the administration strongly disagrees with the decision and that the labor board would continue to conduct business as usual, despite calls by some Republicans for the board members to resign.

"The decision is novel and unprecedented," Carney said. "It contradicts 150 years of practice by Democratic and Republican administrations."


Under the court's decision, 285 recess appointments made by presidents between 1867 and 2004 would be invalid."

In a ruling that called into question nearly two centuries of presidential “recess” appointments that bypass the Senate confirmation process, a federal appeals court ruled on Friday that President Obama violated the Constitution when he installed three officials on the National Labor Relations Board a year ago.

"The Constitution, written at a time when it could take weeks for members of Congress to get to the capital, allows presidents to fill vacancies temporarily during recesses for positions that would otherwise require Senate confirmation. In recent years, as senators have frequently balked at consenting to executive appointments, that authority has served as a safety valve for presidents of both parties.

Mr. Obama has made about 32 such appointments, including that of Richard Cordray, as director of the Consumer Financial Protection Bureau. President Bill Clinton made 139, while Mr. Bush made 171, including those of John R. Bolton as ambassador to the United Nations and two appeals court judges, William H. Pryor Jr. and Charles W. Pickering Sr.

Nearly all of those appointments would be unconstitutional under the rationale of the United States Court of Appeals for the District of Columbia Circuit. It ruled that presidents may bypass the confirmation process only during the sort of recess that occurs between formal sessions of Congress, a gap that generally arises just once a year and sometimes is skipped, rather than other breaks throughout the year. Two of the three judges on the panel also ruled that presidents may fill only vacancies that arise during that same recess."

Friday, the United States Court of Appeals brought the president back to Earth and reminded him that that the Constitution’s Appointments Clause and the U.S. Senate are very much part of reality by voiding three of Obama’s recess appointments to the National Labor Relations Board.

The D.C. Circuit ruled that the president could not end-run the confirmation process merely because at the beginning of 2012 the U.S. Senate was meeting every three business days in, what lawyers call, pro forma session. Oh, and during that pro forma session the Senate was also busy passing the payroll tax extension. Some pro forma session.

In its decision, the Court made clear that our president answers to Article II, Section 2, Clause 2 of the Constitution which, in the words of the Court, “provides that the president ‘shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law.’”
