Defying a veto threat by President Obama, the Senate voted Tuesday to give the U.S. military first crack at holding al Qaeda operatives, even if they are captured in the U.S. and are American citizens, and also reaffirmed the policy of indefinite detention.

“We’re no longer going to have an absurd result that if we capture you overseas where you’re planning an attack on the United States, we can blow you up or put you in a military prison indefinitely, but if you make it to America, all of a sudden you get Miranda rights and you go to federal court,” said Sen. Lindsey Graham, a South Carolina Republican who has fought the Bush and Obama administrations on treatment of suspected terrorist detainees.

Tuesday’s 61-37 vote to buck Mr. Obama and grant the military dibs exposed a deep rift within the Democratic Party. Sixteen Democrats and one independent who caucuses with them defied the veto threat and joined 44 Republicans.

Hope he vetos the new legislation, that would go far in removing him from the White House next year...
 
Oh my, the lefties are not going to like anyone who wants to deny terrorists our rights. I mean, the left has fought hard and long for the right to defend terrorists. How can we deny their hard work?
 
Thank God, at least Sixteen Democrats and one independent show some intelligence on the issue....
 
i've already posted about this, but i'm wondering if you two chickenhawks realize that this also applies to american citizens arrested on this soil?
 
so you're ok with the government being able to arrest somebody on the shoddiest of probable cause, make some hugely vague reference to terrorism, then turn said american citizen over to the military to hold indefinitely?

Of course he is. He is a fear filled authoritarian who wants the Government to protect him.

I never said anything about "being able to arrest somebody on the shoddiest of probable cause". Is that what it says in the bill? Are you hearing voices?

after all the time you've seen me post about police misconduct, you haven't gotten the idea yet that a cop can arrest you for anything, even not breaking the law. all that needs to be said is 'probable cause', then they leave it to the courts to sort out. a simple mention of terrorism related investigation for a transfer to military custody and that person basically disappears.

so if you are comfortable with removing the last remnants of due process of law, cool. we'll just add you to the target list.

and some of us are serious about the constitution, and who the domestic enemies are. you just became one as far as i'm concerned.

both of them are huge violations of the supreme law of the land. are you not worried about that? lets not forget that this bill now includes arrested americans on american soil. if that matters to you at all.

IF they are traitors, they still have rights, according to the constitution.

Section 3 defines treason and its punishment.
“ Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

The Congress shall have Power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted.

I understand your point and sympathize....its a minor dilemma .....I'd rather have these terrorists kept under lock and key and rendered harmless if they are arrested in the US.......rather than just assassinated on the whims of a president or military authority.....the lesser of two evils....our justice system is too fucked up to deal with
terrorists crimes that could put millions in danger.....
