the problem with cherry picking the 'fact finding' is that normally any facts that are found to benefit the defendant don't make it to the jury.

They may be helping to clear him of the allegations that it was a hate crime, did any of you think of it in those terms?
 
the murder investigation is a state function in this case. the ATF is investigating so it can hold a hate crime trial.

There are federal laws that may have been broken .. which is why the Feds are investigating .. which is also not uncommon in murder investigations of this nature.

what exactly are they cherry picking? There was a lot of info just turned over to the defense team. Just a guess, but I doubt the link in the OP covered everything they investigated.

and if they weren't asking questions along the lines of 'racial comments', I would be inclined to agree with you. the ATF does have power to run down any firearm related issues, not racial issues.

as in my previous post, the ATF can run down any firearms related evidence, but I don't believe racial comments are under their purview.
