Loretta Lynch Confirms: It Is Illegal to Transfer GITMO Detainees to the US

Testifying in front of the House Appropriations Subcommittee Wednesday, Attorney General Loretta Lynch reiterated that transferring detainees from Guantanamo Bay Prison to the United States is against the law. From the Washington Times:
Attorney General Loretta Lynch said Wednesday that federal law flatly prevents President Obama from sending of the the detainees from Guantanamo Bay to U.S. territory, hurting his ability to follow through on his new closure plan.

“That is the state of the law,” she said, pointing to the most recent defense policy law passed late last year, which cleared Congress on a bipartisan vote and which Mr. Obama himself signed into law.​

Lynch also pointed this out during testimony in November of last year.


“With respect to individuals being transferred to the United States, the law currently does not allow that,” Lynch testified in front of the House Judiciary Committee. “Certainly it is the position of the Department of Justice that we would follow the law of the land in regard on that issue.”


President Obama sent Congress a plan Monday to permanently close the prison, which includes illegally bringing dozens of high-level terrorists to prison facilities in the United States.


Speaker Paul Ryan immediately pushed back on the proposal, reminding President Obama about bipartisan legislation recently passed in the House and Senate banning detainees from being transferred. Today, Ryan threatened the White House with a lawsuit should President Obama proceed unilaterally.

"If the President proceeds with knowingly breaking the law and asking the military to knowingly break the law he will be met with fierce bipartisan opposition here in Congress and we are taking all legal preparations necessary to meet that resistance," Ryan said during a press conference Wednesday.

So that just means the chances of them coming to a town near you just dropped from 100% to 99.999%, right?
 
I was hoping Obama would have dropped them off in Chicago....if they can escape from the city without getting killed, they get pardoned.

In return, Cuba yielded the U.S. “complete jurisdiction and control” through a perpetual lease that can be voided only by mutual agreement.

The Naval Base in Cuba is land leased by the US gov. and has jurisdiction and control over the leased land, and as stated in the treaty, Cuba has “ultimate sovereignty” over the land and is Cuban territory. It is not US territory.

Gitmo is no different from radical terrorist prisons where people are held indefinitely and not given a chance to defend themselves in court.

They might be similar in that prisoners are detained but I'm confident the comparison ends there. Radical Islamists are barbaric and we're not.

Gitmo is [was, anyway] a talking point to mobilize the left in 2008 and a propaganda point for radical Islamists. Beyond that, it's small potatoes. In fact, the left probably obsesses over it more.

I didn't say it was. Just that the US has complete control and jurisdiction over it. And Gitmo is still wrong.

Of course we were barbaric to Gitmo prisoners. The Senate Intelligence report confirmed it. Those who were tortured said the report didn't go far enough.

I spent over a year on Leeward Point, a tropical paradise....too bad the US isn't into Imperialism....Cuba should be a US state....

So, I guess you would just propose we let 'em go free.....otherwise the only thing left for terrorists is the death penalty....

Nope, I propose they get their day in court and then we decide what happens. And don't tell me they don't fall under the American justice system. It would be inhumane to hold them until the day they die without being charged.
 
You do realize there were seven repubs on the Intelligence Committee and they voted against publishing the report.


Seems they should have kept it classified and it goes without saying, out Hillary's hands.....

others, like you, would put the claims of the terrorists before your own government.....
